Prior to the issuance of the grading permit, the project proponent is to provide the City with copies of the recorded grant deeds/easement deeds for the area within MWD corridor, SCE corridor, flood control channel and SCG. All mitigation/recommendations resulting from the final approved study shall be included in the improvement design submittals. 12. Dedication and construction of an on-site/ or off-site detention basin and related facilities. (1) The length, width and depth to be determined by the completion of a final hydrology/hydraulic study and any proposed tentative tract lot restrictions. The length and width of the proposed basin shall be shown on the final tract map submitted for plan checking. (2) Applicant shall post securities for the basin and_ related facilities construction cost, basin maintenance cost for a 25 year period, the cost to refill, the basin and dispose of any related facilities when no longer needed, as well as regrade the site to a condition suitable for further land use. Applicant shall post securities for the construction of the ultimate storm drain connection to the Master Planned Storm Drain Facilities when operational. (3) Applicant shall execute a 'Declaration of Dedication' Agreement covering the establishment of a flood regulation basin to detain and regulate storm water runoff. (4) Said basin shall be subject to design review and approval by both City staff and Planning Commission. (5) Applicant shall provide a disclosure notice to any purchaser of subdivided or developable land of the requirement to dedicate and construct said detention basin and related facilities and agreements. (6) Applicant shall dedicate at this time, any drainage easements necessary for the placement of the ultimate storm drain pipes and facilities, if necessary, for disposing of the detention basin. Prepare and submit a final grading plan showing- building footprints, pad elevations, finishing grades, drainage routes, drainage acceptance approvals, retaining walls/non-retaining walls and elevations, erosion control, slope easements and other pertinent information in accordance with Chapter 70 of the U.B.C. NOTE: A report on the disposition of trees and shrubs in accordance with Chapter 30 of the Fontana Municipal Code may be required by the Planning Division. 14. The action of. the Planning Commission shall not be final for a period of ten (10) days following the approval hearing to allow the filing of appeals with the City Clerk of the City of Fontana. Under the provisions of Municipal Code Sections 33-165 (k) and 33-142.9 your approval shall become null and void two years after the date of approval. Therefore, your Design Review and Conditional Use Permit shall expire on March 8, 1995. By this date you must see that 'The appropriate permits have been obtained and construction commenced, defined as permits obtainment, commencement of construction of the primary building(s) on site and successful completion of the first Building and Safety Division inspection thereof..." (Section 33-165 (k)(1)) for your Design Review to remain valid. Additionally, by this date the land use approved under your Conditional Use Permit must have commenced. Please be aware that the Code of the City of Fontana does not permit Time Extensions for Design Reviews or Conditional Use Permits approved after April 18, 1991. GENERAL REQUIRENENTS: 1. Prior to the construction of any modifications, all structural and aesthetic changes to the project design must be requested and approved in writing by a Case Planner, Nanager of Planning and the Community. Development Director. All minor changes to approved construction plans must be required and approved as above with the additional authorization from the City Engineer, Manager of Building and Safety and Public Morks Director. Major structural and aesthetic changes exceeding the codified parameters of administrative policy shall be presented to the Planning Commission for approval. Changes made without approval as stated herein, will prevent the issuance of a Certificate of Occupancy until corrections are approved in writing by all appropriate staff. 2. The conditions of approval shall be incorporated into all applicable final construction plans and a copy of these conditions of approval shall be placed onto the first sheet of the final building plans prior to issuance of building permits.
