Dear Mr. Ritchey and Mr. Meyer:
Thank you for your interest in the City of Fontana. Based on a preliminary review of the
application and materials you submitted on September 24, 2012, you are hereby
notified that your application package has been determined to be incomplete for the
purposes of Government Code Section 65920 ("Permit Streamlining Act"). This
determination is made for the following reasons:
1. Three copies of the Storm Water Quality Management Plan are required, only
one was submitted.
2. A second set of self-adhesive stamped envelopes is required.
3. Two additional sets of labels identifying all property owners and mailing
addresses of the project parcels and surrounding properties within 660 feet of the
project boundary is required.
4. A sample board showing the proposed colors and materials for the proposed
Wal-Mart building was not included with the application.
5. A bird's eye view rendering and a colored site plan are required. Also, provide
six color reduced copies (11"X17").
6. Binders containing reduced plans of all the submitted information are required.

Due to these deficiencies, your case may not be further processed until such time as
the needed information is submitted. Upon receipt of this information, your application
will again be reviewed to determine if it can be accepted as complete. Please call me at
your earliest opportunity to discuss the information and/or materials required to rectify
the above deficiencies.

Additionally, specific direction was provided to you at a joint City Council/Planning
Commission workshop held on July 19, 2011, and at a second City Council workshop
held on December 5, 2011. Because your application and proposed development
project will require significant changes to the currently approved Promenade Specific
Plan (PSP), additional information is required for us to process your application in
accordance with the direction of the City Council. Staff has met with you several times
subsequent to the workshops and provided this direction as well, including most
recently, your meeting with Deputy City Manager Debbie Brazill, Community
Development Director Don Williams, and me on June 13, 2012.
The informational items required to process this significant amendment to the approved
PSP include, but are not limited to, the following:
1. Specific examples of the architecture for the proposed commercial parcels shall
be included in the specific plan to reflect Mediterranean/Tuscan architecture to
clearly established the City Council's desired architectural vision for this
important gateway site and eliminate confusion for future property
owners/developers. (You have previously agreed to provide such required
information).
2. An overall site plan including proposed Planning Area No. 12 (property owned by
Mr. Lee and others) shall be required as part of your specific plan amendment
application. A site plan at a concept level may be acceptable. Grades between
the two sites shall be minimal and not require retaining walls between sites.
3. Additional landscape standards shall be included in the specific plan amendment
application requiring enhanced landscaping in the project site.
4. Enhanced pedestrian pathways between the proposed Wal-Mart and the other
pads shall be shown on the plans. Pedestrian linkages between the two sites are
required.

5. Provide standards in the specific plan requiring Planning Area No. 12 to be
developed as a pedestrian oriented center. (This may be included as part of the
information in No. 2 above.)
6. Re-established normal landscape and other setbacks distances to all public right-
of-ways.
As stated to you previously in several meetings with staff, the PSP is an approved
document with established uses and standards, as well as a conceptual site layout and
architectural detail. As opposed to most entitlement applications with which you may be
familiar, the City Council enjoys significant land use authority over specific plans (under
its legislative powers) and, consequently, can require you to assist the City in planning,
conceptually, the property not under your ownership. This has been, and remains, an
important part of the City Council's direction to you and to staff, and is in our opinion an
important component of receiving successful consideration by the Planning Commission
and City Council.

Below is a list of items that requires changes in the site/grading plan for the above reference
development project.
Engineering Land Development (1st Review)
1. Provide marked up plans and comment letter upon re-submittal of updated plans.
2. Utilities to be undergrounded per city code.
3. Show street dimensions on plans.
4. Provide street typical sections on site plan & grading plan.
5. Existing cell tower lease/access agreement to be updated. Provide a copy.
6. Provide full improvement across frontage of project per promenade specific plan.
7. Connect to city sewer.
8. Show proposed street lights on plans per city standard 404.
9. Driveways cannot be used to route drainage onto street.
10.Need to mitigate drainage flows per City's Master storm drainage plan.
11.Utilize existing storm drain lateral on Juniper for connection to project.
12.Provide a preliminary drainage report.
13.Master storm drainage benefit area: 110 North - $20,388 per net acre.

23.Applicant shall provide a Traffic Study Report as required by the latest revision of the
City's Traffic Study and Report Policy. All mitigation recommendations resulting from any
final approved report shall be included in the improvement design submittals.
24.Applicant shall prepare an alignment study reflecting the proposed revisions to the specific
plan.
25.The site/truck entrance on Juniper Avenue does not meet the City of Fontana Access
Management criteria for minimum driveway spacing upstream to a traffic signal.
Minimum distance required is 300' feet for Collector streets.
26.Neither entrance on S. Highland Avenue meets the City of Fontana Access
Management criteria for minimum driveway spacing upstream to a traffic signal.
Minimum distance required is 660' for Primary Highways. The segment between
Sierra and Juniper needs further review by traffic study.
27.Walnut access points will be reviewed with submittal for southern project site.
28.Provide a break in the continuous drive aisle at the southern property line of the parcel.
This drive aisle provides a short cut for vehicle between Sierra Avenue and Juniper
Avenue. Ruble Middle school drop off exit is located opposite this drive aisle.
29.Fast food drive thrus' are difficult to enter. Relocate entrance away from adjacent drive
aisle.
30.Provide better circulation for drive aisles nearest to the pharmacy and adjoining
entrance from S. Highland.
31.All drive aisles to be a minimum of 26' wide.
32.Parking spaces to be 19' x 9'.
33.Provide vehicle loading and unloading area adjacent to store frontage separate from the
26' wide drive aisle.
34.Applicant shall demonstrate adequate truck circulation at driveway locations and on-site in
parking areas using Caltrans Design Manual Turn Templates to the satisfaction of the San
Bernardino County Fire Department and the City Engineer.
35.Applicant shall perform a sight distance analysis that demonstrates adequate stopping
sight distance is provided along street frontages in accordance with City Standard
Plans, taking into consideration intersecting streets, proposed driveways, vertical
elevation differences, and curvilinear alignments to the satisfaction of the City
Engineer. No landscaping, walls, fences, utility structures, or permanent construction
that will be more than 30 inches in height in the critical sight area shall be permitted.
36.Provide all driveways with a minimum width of 35 ft.
37.Provide driveways per city standard. Signalize entries can be designed as an entry
(similar to an intersection) upon approval of traffic study.
38.Provide a bus shelter on Sierra Avenue within the property.
39.Show proposed monument at the intersection of Sierra & S. Highland.
40.Align southerly driveway along juniper with the school driveway across the street.
41.Show proposed median breaks on site plan and grading plan.
42.Southerly driveway along Sierra is dimension incorrectly (48' vs 44').
43.Drive aisles need to align. See plans.
44.Remove medians along southerly drive aisle.
45.The car repair/tire shop bays may conflict with truck turnaround along drive aisle.
Landscape
46.Provide minimum 15% landscaping within property.
47.Meet the water conservation ordinance.
48.Detention basins cannot fall within the landscape set back area. The landscape basin
would need to conform to the city standards of planting & irrigation. Trees and shrubs
would need to be installed per the development code.
49.Screening of the parking lot areas need to be identified. Identify material used, wall,
shrubs, mounding or a combination of the three can be used. Areas of depression such
as basins or bioswales may conflict with this requirement.

51.The final conditions of approval will not be provided until all comments from redlined plans

c. All facilities maintained for the processing, filtering, softening or
conditioning of water. (FMC 23-218)
d. Any facility which has a projected wastewater discharge that exceeds
25,000 gallons of water per day, or which may be categorized as a
Federal Categorical discharger. (FMC 23-216)

gravity separation interceptor to comply with the requirements of Fontana Municipal
Code Section 23-190 unless the requirement is modified by a variance issued by the
Public Services Director.

maintained as required or as needed by the development.
'V All Commercial, Industrial, Institutional, or residential buildings having 5 or more living
units must provide refuse collection areas. These areas (Trash Enclosure) shall be an
adequate size to contain a refuse and recycling bin and provide convenient
accessibility for the collection of these materials. Collection areas must adequately
protect recyclable materials from the harmful effects of the weather. (FMC 24-12, AB
1327)
'V Refuse collection areas use by food service facilities (restaurants, bakeries, coffee or
juice bars, and ice cream stores) shall have a solid roof. (NPDES Standard BMP)
✓ All Commercial, industrial and construction projects must comply with the
requirements of FMC 24-11; General Standards relating to the hauling of refuse
and/or recycling by the City's franchise hauler during construction and post-
construction.
All restaurants which operate a drive through window must have a drive up refuse
container located on the drive through path. Said container must be located within
reach of the customer/driver. (NPDES Standard BMP)
✓All projects that are proposing the use of a trash compactor and are subject to a Water
Quality Management Plan, must comply with the following; Trash compactors shall be
roofed and set on a concrete pad. The pad shall be a minimum of one foot larger all
around than the trash compactor and sloped to drain to a sanitary sewer line.
Connections to the sanitary must have a grease interceptor in line and shall be
protected from rainwater intrusion. (40 CFR, CA-RWQCB Order No. R8-2010-0036-
WQMP)
El All Areas used for fuel dispensing shall be paved with Portland cement concrete (or;
equivalent smooth, impervious surface) with a 2% to 4% slope to eliminate or reduce
ponding, and must be separated from the rest of the site by a grade break that
eliminates or reduces run-on of stormwater. Concrete surfacing must extend a

minimum of 6.5 feet from the corner of each fuel dispenser, or the length at which
the hose and nozzle assembly may be operated plus one foot, whichever is less.
The fuel dispensing area shall be graded and constructed as to eliminate or reduce
stormwater flow through the concrete fueling area. Spilled material within the fuel
dispensing area must be prohibited from draining to the street or storm drain system,
or offsite. Spills must be immediately cleaned up in accordance with a Spill
Contingency Plan. All fuel dispensing areas are to have a canopy structure, and the
canopy's minimum dimensions must be equal to or greater than the area within the
grade break or the fuel dispensing area, as defined above. Canopy roof downspouts
are to be routed to eliminate or reduce drainage across the concrete fueling area.
The fueling area shall drain to the project's Treatment Control BMP(s) prior to
discharging to the municipal storm drain system, or offsite (40 CFR, CA-RWQCB
Order No. R8-2002-0012).
❑Areas used for air/water supply must be graded and constructed so as to contain
spilled material for cleanup.
Prior to the Issuance of any permits
✓All construction projects that are required to obtain coverage under the State's General
Construction Storm Water Permit must file with the State Board a "Notice of Intent" to
be covered by the relevant General Permit. Applicants shall be required to provide a
copy of the Waste Discharger Identification Number (WDID) issued by the State Board

. 2. Automatic fire suppression systems shall be installed in all new construction per Article II,
Chapter 11 of the Code of the City of Fontana. Design and type of system shall be based upon
the requirements of the Building Code, Fire Code and the requirements of the Fontana Fire
Prevention District.
. 3. The requirements of the Department of Environmental Health Services and the Air Quality
Management District shall be satisfied prior to the issuance of any permit if hazardous
materials are stored and/or used.
4. Any temporary building, trailer, commercial coach, etc. installed and/or used in connection
with a construction project shall comply with City Code.
. 5. All perimeter/boundary walls shall be designed and constructed so that the outer/exterior face
of the wall is as close as possible to the lot line. In any case, the outer/exterior face of the wall
shall be within two (2) inches of the lot line. Distances greater than two (2) inches may be
approved prior to construction by the Building Official on a case by case basis for extenuating
circumstances.
. 6. All lot lines, easement lines, etc. shall be located and/or relocated in such a manner as to not
cause any existing structure to become non-conforming with the requirements of the latest
adopted edition of the Building Code, or any other applicable law, ordinance, or code.
. 7. The Tract or Parcel map shall record prior to the issuance of any permits.

■ 8. Grading Requirements:
• A. Grading plans shall be submitted to, and approved by the Building & Safety
Department. The grading plans shall indicate all site improvements, and shall indicate
complete drainage paths of all drainage water run-off.
• B. All drainage water shall drain via approved methods, to an approved location — public
street, public drainage system, etc.
• C. Drainage water shall not cross over a public sidewalk. Drainage water may however
cross under a sidewalk if an approved drainage structure is used.
■ D. No water course or natural drainage shall be obstructed.
■ E. Indicate minimum slope or grade for ALL drainage structures.
• F. Drainage water shall not pass from an `improved' type of drainage structure to an
`unimproved' type of drainage structure. (i.e.; concrete swale to slag or dirt swale.)
■ G. A complete hydrology study using the latest edition of the San Bernardino County
Flood Control Hydrology Manual, and complete hydraulic calculations justifying the
size, slope, capacity, etc. of any and all drainage structures being utilized, shall be
submitted to, and approved by the Building& Safety Department.
The on-site drainage system shall, as a minimum, be designed to handle the run-off
generated by a ten (10) year storm. Check for flooding of all on-site structures
(buildings) and all adjacent properties during a hundred (100) year storm.
■ H. The grading plans shall, as a minimum, contain sections at all lot lines and/or permit
boundary lines. These sections shall clearly indicate:
1. The relationship between the proposed finished on-site grade elevations and the
existing adjacent property grade elevations (Indicate any additional drainage
water that may come from an adjacent property.); and
2. The ground cover/finished surface material being proposed (i.e.: type of
pavement,plant material, etc.); and
3. All proposed drainage structures; and
4. Any proposed and/or required walls or fencing.

■ 9. All signs shall be Underwriters Laboratories, or equal, approved.
■ 10. Permits are required prior to the removal and/or demolition of structures.
11. In addition to approval from the Building & Safety Department, approval is required from the
County of San Bernardino, Department of Public Health and the California Regional Water
Quality Control Board, Santa Ana Region for the Private Sewage Disposal System.
12. The existing private sewage system will have to be modified as required to accommodate the
new use. Plans and/or supporting data will have to be submitted to, and approved by, the
Building & Safety Department regarding the new use and necessary modifications.
Additionally, approval from the Regional Water Quality Control Board, Santa Ana Region, is
required for the new use.
13. The coach shall bear a State of California, Department of Housing and Community
Development (HCD) insignia indicating the occupancy group and design loads that the coach
conforms to, and other relevant information regarding exiting, fire safety, electrical, plumbing
and mechanical. The foundation system, porch and awning shall comply with plans that bear
the HCD "Standard Plan Approval" stamp. The coach, foundation system, porch and awning
shall comply with the City of Fontana's design loads and site specific conditions.
14. The conversion of the existing single family dwelling(s) into a commercial use changes the
occupancy group classification, and therefore the existing buildings must be made to comply
with the requirements of all applicable codes for the new occupancy classification. Complete
plans, calculations and other specifications shall be submitted to the Building & Safety
Department for review, approval and subsequent permit issuance. The plans, calculations and
other specifications shall be prepared by an Architect or Registered Civil/Structural Engineer
licensed by the State of California who is qualified to perform said work.
15. The site, or a portion of the site, is located in a flood hazard area. Justification that the
proposed development does not adversely affect the location or carrying capacity of the
floodway, nor does it adversely affect upstream or downstream sites shall be provided to the
Building & Safety Department. Additionally, all development shall comply with Chapter 12—
FLOOD CONTROL of the Code of the City of Fontana and all requisite provisions must be
taken to protect the site from flood damage.
■ 16. All exterior lighting shall be orientated, directed, and/or shielded as much as possible so that
direct illumination does not infringe onto adjoining properties.

■ 17. The following items shall be completed and/or submitted to Building& Safety—as applicable

■ 18. If hazardous substances are used and/or stored, a technical opinion and report, identifying and
developing methods of protection from the hazards presented by the hazardous materials may
be required. This report shall be prepared by a qualified person, firm, or corporation and
submitted to the Building & Safety Department. This report shall also explain the proposed
facility's intended methods of operation and list all of the proposed materials, their quantities,
classifications, and the effects of any chemical (material) inter-mixing in the event of an
accident or spill.
■ 19. The existing parcels shall be combined into a single parcel, or a lot line adjustment shall be
done so that the proposed structure(s) does not cross any lot line and complies with all
requirements of the California Building Code, prior to any building permits being issued.

• 5.0 ft. wide (prefer 6 ft. wide for walkability); ( U) widen for double stroller
• Pedestrian linkages need to be visually marked, since front entrance is set back
from street for pedestrian access from street; want to encourage walkability,
connectivity within the neighborhoods.
• Crosswalks need to be indicated for better pedestrian paths.
❖ Parking structure:
• No lighting plan indicated; 1ft candle standard.
• Parking areas need to be well lit for pedestrian access.
• Note: Pedestrian walkways are indicated, but need to encourage again walkability
with the surrounding neighborhoods. The pedestrian sidewalks in the parking
structure need to be accessible from the street to the front entrance; long sidewalks
need to be at least 6" for people to use strollers and charts and so they do not walk
between cars.
This project represents design that does not incorporate connectivity, walkabilty or smart
growth concepts into its layout. Need 5-6 ft. wide sidewalks on both sides with walking paths to
connect the neighborhood. Residential housing in the City of Fontana should offer residents
the ability to have an active and healthy lifestyle because of the design of the built environment
around them; even it is commercial.

Here are my comments:
1.) All drive aisles throughout the project shall be a minimum of 26 feet in width in order to accommodate two-
way traffic for Fire Department vehicles. Loading areas and equipment shall not obstruct required fire lanes.
Please correct this on the site plan.
2.) It is recommended that the drop off/unloading area in front of the building be expanded to accommodate
more vehicles.This area must be wide enough so that the adjacent fire access lane is not obstructed, preferably
34 feet.
Also, they are in the Trak-it.
