17. MAINTENANCE
A. AFTER ALL INDICATED ON THE DRAWINGS, IN THE SPECIFICATIONS, OR
HEREIN SPECIFIED HAS BEEN COMPLETED, INSPECTED, AND APPROVED, THE
CONTRACTOR SHALL MAINTAIN ALL PLANTED AREAS BY MEANS OF
CONTINUOUS CULTIVATION, WATERING, WEEDIN6, ROLLING, AND/OR ANY OTHER
OPERATION NECESSARY TO THEIR CARE AND UPKEEP FOR A PERIOD OF NOT
LESS THAN NINETY (40) DAYS. AT THE END OF THE MAINTENANCE PERIOD,
ALL PLANTED MATERIAL SHALL BE IN A HEALTHY, 6ROWIN6, WEED -FREE
CONDITION.

MAINTENANCE PROGRAM BY UTILIZATION OF A COMPETENT AND LICENSED
LANDSCAPE MAINTENANCE CONTRACTOR.
B. PROTECTION OF INTEREST
THE CONTRACTOR PROTECTING H15 OWN INTEREST, 15 OBLIGATED TO
PERIODICALLY CHECK WORK AFTER HI5 MAINTENANCE PERIOD 15 OVER AND
FINAL ACCEPTANCE HAS, BEEN MADE, TO INSURE THAT PROPER MAINTENANCE
PROCEDURES ARE BEING IMPLEMENTED. ALL REPORTS SHALL BE MADE TO
OWNER IN WRITING IMMEDIATELY FOLLOWING VISITATION.
G. IMPROPER MAINTENANCE

LANDSCAPE CONTRACTOR TO "LIVE AND GROW" IN AN 'ACCEPTABLE,
UPRIGHT P051 TION" FOR A PERIOD OF ONE (1) YEAR AFTER COMPLETION OF
THE SPECIFIED MAINTENANCE PERIOD AND FINAL ACCEPTANCE. DEFINITION
OF "LIVE AND GROW" AND 'ACCEPTABLE, UPRIGHT POSITION" SHALL MEAN
THAT THE THEE MUST, DURING THE GUARANTEE PERIOD, SUSTAIN A HEALTHY,
VIGOROUS APPEARANCE. IT SHALL NOT DEFOLIATE MORE THAN THIRTY (30
%) PERCENT NOR SHALL THIRTY (30%) OF THE FOLIAGE BE DRIED AND
UNHEALTHY IN APPEARANCE. IF THE TREE, DURING THE GUARANTEE PERIOD,

F. LIMITS OF GUARANTEE RESPONSIBILITY
PURCHASE OF, THE DELIVERY OF, OR THE PLANTING OF ANY AND ALL PLANT
MATERIAL SHALL NOT ELIMINATE THE OBLIGATION OR EXCUSE THE
LANDSCAPE CONTRACTOR FROM H15 RESPONSIBILITIES TO GUARANTEE THE
PLANT MATERIAL AS SPECIFIED ON THE DRAN NGS OR PER THESE
SPECIFICATIONS.
G. WRITTEN NOTIFICATION
THE LANDSCAPE CONTRACTOR SHALL, WITHIN TEN (10) DAY5'OF WRITTEN
NOTIFICATION BY THE OWNER OR HIS DULY AUTHORIZED REPRESENTATIVE,
REMOVE AND REPLACE ALL GUARANTEED PLANT MATERIAL WHICH FOR ANY
REASON FAILS TO MEET THE REQUIREMENTS OF THE GUARANTEE.
REPLACEMENT SHALL BE MADE WITH PLANT MATERIALS OR161NALLY
SPECIFIED AND SHALL MEET ORIGINAL GUARANTEES.
