1. CONTRACTOR AGREES THAT HE SHALL ASSUME SOLE AND COMPLETE
RESPONSIBILITY FOR JOB SITE CONDITIONS DURING THE COURSE OF
CONSTRUCTION, INCLUDING SAFETY OF ALL PERSONS AND PROPERTY. TfttS

WORKING HOURS. THE CONTRACTOR SHALL DEFEND, INDEMNIFY AND HOLD
THE CITY, OWNER AND ENGINEER HARMLESS FROM ANY AND ALL LIABILITY,
REAL OR ALLEGED, IN CONNECTION WITH THE PERFORMANCE OF THE WORK M
THIS PROJECT, EXCEPTING FOR LIABILITY ARISING FROM THE SOLE
NEGLIGENCE OF THE OWNER OR ENGINEER.
2. ALL UNDERGROUND UTILITIES OR STRUCTURES, REPORTED OR FOUND IN
PUBLIC RECORDS, ARE INDICATED WITH THEIR APPROXIMATE LOCATION AND
EXTENT. THE OWNER, BY ACCEPTING THESE PLANS OR PROCEEDING WITH THE
IMPROVEMENTS HEREON, AGREES TO ASSUME LIABILITY AND HOLD THE
ENGINEER HARMLESS FOR ANY DAMAGES RESULTING FROM THE EXISTENCE OF
UNDERGROUND UTILITIES OR STRUCTURES NOT REPORTED OR INDICATED ON
PUBLIC RECORDS, OR THOSE CONSTRUCTED IN VARIANCE WITH REPORTED OR
RECORD LOCATIONS. THE CONTRACTOR IS REQUIRED TO TAKE DUE
PRECAUTIONARY MEASURES TO PROTECT THE UTILITIES OR STRUCTURES
SHOWN AND ANY OTHERS FOUND AT THE SITE. IT SHALL BE THE CONTRACTORS
RESPONSIBILITY TO NOTIFY THE OWNERS OF ALL UTILITIES OR STRUCTURES
CONCERNED BEFORE STARTING WORK.
3. THE ENGINEER PREPARING THESE PLANS SHALL NOT BE RESPONSIBLE OR
LIABLE FOR UNAUTHORIZED CHANGES TO OR USES OF THESE PLANS. ALL
CHANGES TO THESE PLANS MUST BE REQUESTED IN WRITING AND MUST BE
APPROVED BY THE ENGINEER OF RECORD.

CONTRACTORS SHALL BE RESPONSIBLE FOR DETERMINING THEIR OWN
QUANTITIES PRIOR TO BIDDING AND CONSTRUCTION. THE ENGINEER IS NOT
RESPONSE FOR DISCREPANCIES IN FILIAL CONSTRUCTION QUANTITIES.
!�. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO VERIFY ALL
DIMENSIONS AND CONDITIONS SHOWN HEREON AT THE JOB SITE PRIOR TO ANY

7. CONTRACTOR IS TO NOTIFY "UNDERGROUND SERVICE ALERT" AT 1 (800) 227-2600
AT LEAST TWO (2) WORKING DAYS PRIOR TO START OF WORK SO AS TO HAVE
LOCATION OF UNDERGROUND UTILITIES LOCATED AND MARKED FOR
CONSTRUCTION / SAFETY COORDINATION.
8. CONTRACTOR SMALL COMPLY WITH REWREMENTS OF FEDERAL, STATE AND
LOCAL LAWS AND REGULATIONS PERTAINING TO CLEAN AIR AND CLEAN
WATER ACT.
9. EXCEPT IN AN EMERGENCY, EVERY PERSON PLANNING TO CONDUCT ANY
EXCAVATION SHALL CONTACT THE APPROPRIATE REGIONAL NOTIFICATION
CENTER, AT LEAST TWO (2) WORKING DAYS, BUT NOT MORE THAN FOURTEEN
(14) CALENDAR DAYS, PRIOR TO COMMENCEMENT OF THE EXCAVATION.
SECTION 4216.2(A) CHAPTER 3.1, DIVISION 5, TITLE 1, CALIFORNIA CODE.
10. ALL AGENCY REQUIREMENTS SET FORTH ON ANY PERMITS REQUIRED FOR
CONSTRUCTION OF THIS PROJECT WHETHER REFERENCED HEREIN OR NOT,
SHALL BE COMPLIED WITH AS IF THEY WERE PART OF THESE PLANS AND
SPECIFICATIONS. PFEILER do ASSOCIATES ENGINEERS, INC. SHALL NOT BE
RESPONSIBLE FOR CONTRACTORS NON-COMPLIANCE.
11. PRESERVING ANY AND ALL CONS'TRtJCTION SURVEY STAKES AND MARKS FOR
THE DURATION OF THEIR USEFULNESS SHALL BE THE RESPONSIBILITY OF THE
CONTRACTOR. IF, IN THE OPINION OF THE ENGINEER, SURVEY STAKES OR
MARKS HAVE BEEN CARELESSLY OR WILLFULLY DESTROYED OR DISTURBED BY
THE CONTRACTOR THE COST OF RESETTING THEM SHALL BE BORNE BY THE
CONTRACTOR. IF THE CONTRACTOR ELECTS NOT TO HAVE THE STAKES RESET,
HE AGREES TO ACCEPT FULL RESPONSIBILITY FOR THE LINE AND GRADE OF THE
FINISHED WORK.
12. THREE CONSECUTIVE SURVEY STAKES OR MARKS ON THE SAME SLOPE SHALL
BE USED TO DETERMINE A STRAIGHT GRADE. ANY VARIATIONS FROM A
STRAIGHT GRADE SHALL BE REPORTED TO THE ENGINEER. IF THE CONTRACTOR
ELECTS NOT TO REPORT VARIATIONS IN GRADE, HE AGREES TO ACCEPT FULL
RESPONISIBUM FOR THE GRADE OF THE FINISHED WORK.

REQUIREMENTS OF THE DIVISION OF INDUSTRIAL SAFETY OF THE STATE OF CAUFORNIA. TRENCHES
LESS THAN FIVE" (5) FEET SHALL ALSO BE GUARDED WHEN THE POTENTIAL EXISTS' FOR GROUND
MOVEMENT.
17. THE CONTRACTOR SHALL OBTAIN A PERMIT FOR PERFORM EXCAVATION OR TRENCH WORK FOR TRENCHES
5 FEET OR GREATER IN DEPTH FROM THE CALIFORNIA STATE DIVISION OF INDUSTRIAL SAFETY.

DENSITY SHALL REQUIRE RE -WORKING OF THAT PORTION OF THE WORK UNTIL THE SPECIFIED DAY IS
OBTAINED.
22. ALL MATERIALS AND METHODS ARE SUBJECT TO THE APPROVAL OF THE CfTY ENGINEER.
23. ADEQUATE CONSTRUCTION CONTROL STAKES SHALL BE SET BY THE ENGINEER TO ENABLE THE CONTRACTOR
TO CONSTRUCT THE WORK TO THE PLAN GRADES. THE CONTRACTOR SHALL BE RESPONSIBLE FOR THE
PRESERVATION OF BENCHMARKS AND CONSTRUCTION CONTROL STAKMNG DURING CONSTRUCTKK
24, CARE SHOULD BE TAKEN TO PREVENT GRADES, DITCHES, AND SWALES FROM UNDERMINING STREET
IMPROVEMENTS UPON INSPECTION OF THE SITE. THE CITY ENGINEER MAY REQUIRE TEMPORARY
NON-ERODEABLE SWALES ENTERING OR LEAVING IMPROVEMENTS.
25. THE CONTRACTOR SHALL NOT DISTURB EXISTING SURVEY MONUMENTS. MONUMENT TIES OR BENCH MARKS
WITHOUT PRIOR NOTIFICATION TO THE CITY ENGINEER.
2L REMOVAL AND REPLACEMENT OF DOSTM SURVEY CONTROL, INCLUDING SURVEY MONUMENTS, MONUME14T
TIES AND BENCH MARKS, SHALL BE DONE BY A REGISTERED CML ENGINEER OR LICENSED LAND SURVEYOR.
SURVEY MONUMENTS THAT WILL BE DESTROYED AS A RESULT OF THE CONSTRUCTION SO THAT TIES TO
MONUMAENTS CAN BE ESTABLISHED FOR LATER REPLACEMENT OF THE MONUMENT.
27. PAVEMENT STRUCTURAL. SECTIONS SHOWN ARE MINIMUM AND SUBJECT TO REVISION AND APPROVAL OF THE CfTY
ENGINEER AS DETERMINED BY SOILS TENS TAKEN AFTER COMPLETATiON OF ROUGH GRADING.
21L ACTUAL. THICKNESS OF A.C. PAVEMENT AND/OR SASE COURSE MATERIAL FOR STRUCTURAL STREET SECTIONS SHALL
BE RECOMMENDED BY A GEOTECHNICAL REPORT AND SUBMITTED TO THE CITY OF FONTANA FOR APPROVAL UPON
COMPLETION OF ROUGH GRADING.
29. THE CONTRACTOR SHALL MAINTAIN ACCESS FOR LOCAL RESIDENTS AND BUSINESSES AT ALL TIMES. A MMNMlM
12 FOOT LANE SHALL BE MAINTAINED AT ALL TIMES IN THE CLOSURE AREA FOR RESIDENTIAL AND EMERGENCY
VEHICLES.
30. NO MATERIAL OR EQUIPMENT SHALL BE STORED IN THE PUBLIC RIGHT-OF-WAY WITHOUT PRIOR APPROVAL
OF THE INSPECTOR.

OTHER TRAFFIC CONTROL DEVICES TO THE SATISFACTION OF THE CITY TRAFFIC ENGINEER.
35. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO MAINTAIN BARRtCADES. DELINEATORS OR OTHER
TRAFFIC CONTROL DEVICES AT ALL TIMES.
