Pursuant to the provisions of Section 3086 of the Civil Code of the State
of California and authorization of the City Council of the City of Fontana,
NOTICE IS HEREBY GIVEN that work on that certain project known as

To Whom It May Concern:
The Kenko, Inc. has recently completed the construction of Cypress Avenue Sewer Project in
the City of Fontaria. The project was completed on time and within budgeted amount. Kenko
staff was very co-operative and followed all direction from the City Staff. There were no
safety violations reported on the project and traffic control was properly maintained. The
project consisted of approximately 10,500 L.F. of 30", 27" and 24" VCP gravity sewer including
4" sewer laterals. It also included 362' of 54" jacked casing under the Interstate 10 and
Southern Pacific Rail Lines. All work was performed in a professional manner and was well
coordinated with the property owners.

Gas Company Claim (S-2661~28-34-MC)
Dear Mr. Schwarz:
Enclosed is a copy of the claim letter, filed by the Gas Company, for the repair cost
to their 2" gas main caused by Kenko, Inc~ construction equipment at intersection of
Cypress and San Bernardino Avenue. Kenko, Inc. must submit a letter from the Gas
Company verifying that Kenko has paid t~is claim. The City will not finalize project
accounting without written verification from the Gas Company.
Attached is a copy of page GC-3 from the contract documents indicating the
responsibility of the contractor in terms o~ existing utilities.

The California Public Utilities Commission mandates that, in the
interest of public safety, main lihe gas valves be maintained in
a manner to be readily accessible and in good operating condition.
The Contractor shall notify the SoUthern California Gas Company's
Headquarters Planning Office at 714/335-7769 at least two (2)
working days prior to the start of construction.
The Contractor shall exercise extreme care to prote~t all existing
utilities in place whether shown On the Plans or not, and shall
assume full responsibility for ~11 damage resulting from his
operations. The Contractor shall coordinate with each utility
company as to the requirements andSmethods for protection of their
facilities during the construction period, and shall be responsible
for preparation and processing of any required Plans or permits.

1993, I have reviewed the three dhplicate originals of the Escrow
Agreement for Security Depositslin Lieu of Retention made and

of the Contract Code.
The three duplicate orlginals are exactly in the form

ESCROW AGREEMENT FOR SECURITY DEPOSITS
IN LIEU OF RETENTION
This Escrow Agreement is made and entered into by and between City of Fontana whose address
is City Hall - 8353 Siena Ave.. Fontaria, Ca. 92335 (hereinafter called "owner"); Kenko. Inc.
whose address is 1694 91st Ave. N.E. - Blaine. MN 55449 (hereinafter called "Contractor");
and American National Bank and Trust Company whose address is 101 E.. Fifth St.. St. Paul.
Mn. 55101-1860 (hereinafter called "Escrow Agent").
FOR THE CONSIDERATION HEREINAFTER SET FORTH, THE OWNER, CONTRACTOR,
AND ESCROW AGENT AGREE AS FOLLOWS:
(1) Pursuant to Section 22300 of the Public Contracts Code of the State of California,
Contractor has the option to deposit securities with Escrow Agent as a substitute
for retention earnings required to be withheld by Owner pursuant to the
Construction Contract entered into between the Owner and Contractor for C.vpress
Avenue Sewer Project in the amount of $1,578.638.00 dated September 15.
1992_ (herein after referred to as the "Contract"). When Contractor deposits the
securities as a substitute for Contract earnings, the Escrow Agent shall notify the
Owner within ten days of the deposit. The market value of the securities at the
time of the substitution shall be at least equal to the cash amount then required to
be withheld as retention under the terms of the Contract between the Owner and
Contractor. Securities shall be held in the name of City of Fontana and shall
designate the Contractor as the beneficial owner.
(2) The Owner shall make progress payments to the Contractor for such funds which
otherwise would be withheld from progress payments pursuant to the Contract
provisions, provided that the Escrow Agent holds securities in the form and
amount specified above.

(3) Alternatively, the OWNER may make payments directly to
Escrow Agent in the amount of retention for the benefit
of the OWNER until such time as the escrow created
hereunder is terminated.
(4) Contractor shall be responsible for paying all fees for
the expenses incurred by Escrow Agent in administering
the escrow account. These expenses and payment terms
shall be determined by the Contractor and Escrow Agent.
(5) The interest earned on the securities or the money market
acct's held in escrow and all interest earned on that
interest shall be for the sole account of Contractor and
shall be subject to withdrawal by Contractor at any time
and from time to time without notice to the OWNER.
(6) Contractor shall have the right to withdraw all or any
part of the principal in the Escrow Account only by
written notice to Escrow Agent accompanied by written
authorization from the OWNER to the Escrow Agent that
OWNER consents to the withdrawal of the amount sought to
be withdrawn by Contractor.
(7) The OWNER shall have a right to draw upon the securities
in the event of default by the Contractor. Upon seven
days written notice to the Escrow Agent from the OWNER of
the default, the Escrow Agent shall immediately convert
the securities to cash and shall distribute the cash as
instructed by the OWNER.
(8) Upon receipt of written notification from the OWNER
certifying that the Contract is final and complete, and
that the Contractor has complied with all requirements
and procedures applicable to the Contract, Escrow Agent
shall release to Contractor all securities and interest
on deposit less escrow fees and charges of the Escrow
Account. The escrow shall be closed immediately upon
disbursement of securities on deposit and payments of
fees and charges.
(9) Escrow Agent shall rely on written notifications from the
OWNER and the Contractor pursuant to Sections (4) to (6),
inclusive, of this agreement and the OWNER and Contractor
shall hold Escrow Agent harmless from Escrow Agent's
release and disbursement of the securities and interest
as set forth above.

written notice or to receive written notice on behalf of
the OWNER and on behalf of Contractor in connection with
the foregoing, and exemplars of their respective

Dear Mr. Molinos:
In accordance with the request of Mr. Bob Waddle of the City of Fontana, this letter
provides our recommendations related to surcharge pressures on the subject utility, due
to future embankment construction. We understand that a future freeway ramp is
proposed for the Interstate 10 at Cypress Avenue and that it may consist of fills up to 30
feet high. Based on the project plans prepared by NBS/Lowry, the sewer will be
constructed approximately 20+_ feet below ~ (prior to embankment) grades. We
also understand that the pipe will be shaded with crushed stone.
AsSuming that the backfill immediately over the pipe is densely compacted (results in
highest load transfer to a buried conduit). the total load resulting from 20 feet of
compacted backfill in an 8 foot wide trench will be on the order of 12,000 pounds per foot
of conduit (based on Spangler, 1951). The addition of 30 feet of soil over the
aforementioned condition will result in a .t~ load on the order of 20,000 to 22,000
pounds per foot.
One relatively inexpensive and simple method to signfficantly reduce loads is by
placement of a zone of loose fill directly over the pipe. The following procedure can be
utilized to reduce these pressures. The mechanism by which the stresses are
redistributed are very complex; from a simple viewpoint, soil 'erching" will distribute
stresses around a buried conduit.
1. Over-excavate bottom of trench at least 6 inches. Backfill 6 inches with gravel (or
crushed stone as shown on plans), hand form to conform to bottom of pipe for
uniform support, and place pipe.

2, Place gravel around sides of pipe to 6 inches above spring line, Mechanically
compact gravel at spring line using a narrow backhoe-mounted sheepafoot wheel
or hand-held compaction equipment. Compaction should consist of a minimum
of four passes over the gravel.
3. Place 4 feet of moisture conditioned on-site soil in one lift over pipe/graveL
Compact the lift at the sides of the trenches only, Compaction over the top of the
pipe should not be performed.
4. Place and compact balance of backfill in normal manner.
The resulting reduction of surcharge over thej pipe is difficult to determine. We estimate,
conservatively, that the loads on the pipe, provided the above procedures are usbd, will
be reduced by at least 50 percent.
If this method of stress reduction is used, the procedure should be performed on the pipe
where the pipe occurs within a zone under the embankment defined by a 1:1 downward
projection off the base of the embankment.

Notice to Proceed
Dear Mr. Schwarz:
You are hereby notified to commence work on the above referenced contract on
November 10, 1992, end shall fully complete all of the work of said contract
within 110 calendar days thereafter. Your completion date is thereforeApril 20,
1993. Enclosed for your records is a fully executed copy of the contract
documents.
Per Contract Specification, Special Provisions, Section 6-9, the contractor shall
pay any liquidated damages to the agency! in the sum of $500 per day for each and
every calendar day of such delay after the completion date.
Before actual start of any construction activities, contractor must have an
approved traffic control detour plan from the City. Also, contractor must have
a letter on file with the City from property owner authorizing contractor to use
their property for stock piling if contractor intends to do so. Letter should
have proper address for the property to be used.
contractor must obtain city construction permit from the Engineering counter at

Engineer and the Police Department prior to beginning work.
The contract shall provide adequate detours to the satisfaction of the
Ctty Traffic Engineer. A detatled plan of such detours shall be
submitted to the Ctty Traffic Engineer at least five (5) days prior to
the :1me the contractor wishes to close off the street or in any way
restrtct the traffic flce. in actual street closures, the submitted
plan she11 tndtcate the route of the detour, the character of the
temporary pavement where required, and a layout of the locations of
signs and lighting. in all other cases, the contractor shall provide
adequate traffic flow in both directors where possible and in those
cases where both directions of traffic cannot be maintained the
contractor shall provide flagmen whose sole duties consist of directing
traffic through and around the work. In all cases, the approval of a
suitable plan shall be granted the. contractor prior to beginning
construction.
Fatlure or refusal by the contractor to comply with the above-mentioned
requirements shall be sufficient cause for the City Engineer to order
the work done by city forces and the cost therein to be borne by the
contractor.

AGREEMENT
RE: Use of Property located at Northeast corner of Cypress and Stover Avenues in the City of
Fonlana.
This is an agreement between Ruberto Zamora to allow Kenko Ine. to store equipment and material
related to the constrttction of Cypress Avenue Sewer project on approximately 5,600 sq. foot of
above mentioned property. Kenko agrees to pay the sum of $300.00 per month for this use which
is anticipated to be 6 months. Kenko agrees to hold owner harmless for any damage to said stored
materials, and equipment or loss of same. Kenko further agrees to restoore this property to its
original condiition and accepts responsiblity for any damages resulting form use of said property.

Re: Cypress Avenue Sanitary Sewer Project.
Within the next two weeks, we will begin construction of a new 30" sewer main on Cypress
Avenue. This work will begin at Jurupa Avenue and progress to the north to the 1-10 Freeway.
Cypress Avenue will be closed to through traffic during this construction. It will be open to local
residence and emergency vehicles only. Your driveway will have limited access during actual
placement of pipeline in your area. We will coordinate closely with each residence prior to
restricting access to your property.
Sewer pipe will be placed within the right of way prior to actual trenching. This sewer main will
be installed at depths in excess of 20' creating a dangerous area for persons not related to the
construction. We place a high priority on public ~afety, and ask you to help us by limiting your
activity in the construction area to ingress and egress of your property only. We apologize for any
inconvenience this may create. Your cooperation is this matter is appreciated.
