ACCEPT AS COMPLETE THE WORK PERFORMED BY KENKO, INC. FOR THE CONSTRUCTION OF THE CITRUS. AVENUE SEWER FROM JURUPA AVENUE TO SLOVER AVENUE; AUTHORIZE THE CITY ENGINEER 'TO EXECUTE AND FILE THE NOTICE OF COMPLETION FOR CITY PROJECT SB-55-00; AND APPROVE THE FINAL CONSTRUCTION AMOUNT OF $2,379,022.86 SYSTEM. COUNCIL,`GOALS: • To or promote economic development by pursuing business retention, expansion and at traction. To invest in infrastructure. To concentrate on inter -governmental relations by working cooperatively with neighboring jurisdictions. DISCUSSION: On December 21, 1999, the City Council authorized staff to advertise for bids for the construction of the Citrus Avenue Sewer and Storm Drain Project from Jurupa Avenue to Slover Avenue, authorized the City Manager to award the construction contract to the lowest responsiblebidder, and authorized a construction contingency fund in the amount of 10% of the awarded construction contract amount. :ADOPT RESOLUTION 2001- , ACCEPTING THE SEWER IN CITRUS AVENUE • FROM JURUPA AVENUE TO SLOVER AVENUE AS PART OF THE CITYSEWER infrastructure by providing for the development of new On July 20, 2000, the City Clerk received twenty (20) bid proposals for the construction of this project. The bids were publicly opened at 10:00 A.M. in the City Council Chambers by the City Clerk's office. After review of the proposed bid documents and reference checks, Kenko, Inc. was determined as the lowest responsible bidder. On September 5, 2000 the City Manager entered into a construction contract with Kenko, Inc. in the amount of $2,212,515.00. The final contract amount of $2,379,022.86 includes a total of contract change orders in the amount of $1'66,507.86 (7.51%) FISCAL IMPACT: Funds are available in Fund 502 Sewer Capital, Fund 426 Storm Drain, and Fund 423 Capital Investment and budgeted in FY 2001/02. THE CITY COUNCIL OF THE CITY OF FONTANA ACCEPTING THE CITRUS AVENUE SEWER FROM JURUPA AVENUE TO SLOVER AVENUE AS PART OF THE SEWER SYSTEM WHEREAS, Section 23-388 of the Code of the City of Fontana provides that each addition to or extension of the sewer system shall be accepted by Resolution of the City Council; and WHEREAS, the resolution of Acceptance shall contain the terms of any special consideration which shall apply to the sewer so accepted; NOW, THERFORE, BE IT RESOLVED, by the City Council of the City of Fontana, that sewer mains and laterals within Citrus Avenue from Jurupa Avenue to Slower Avenue is hereby accepted as part of'the sewer system of this City: APPROVED AND ADOPTED this 4th day of September, 2001 READ AND APPROVED AS TO LEGAL FORM: City Attorney I, Beatrice Watson, City Clerk of the City of Fontana, and Ex-Officio Clerk of the City Council do hereby certify that the foregoing resolution is the actual resolution duly and regularly adopted by the City. ACCEPT A BID IN THE AMOUNT OF TWO MILLION TWO HUNDRED TWELVE THOUSAND FIVE HUNDRED FIFTEEN DOLLARS ($2,212,515.00) AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A CONTRACT WITH ,0 1NC., dba McGRAND AND ASSOCIATES FOR THE CONSTRUCTION OF CITRUS AVENUE SEWER AND STORM DRAIN FROM JURUPA AVENUE TO SLOVER AVENUE; AND AUTHORIZE 10% CONSTRUCTION CONTINGENCY FUND IN THE AMOUNT OF $221,251.50. COUNCIL GOALS: To promote economic development by aggressively pursuing annexations. To invest in the City's infrastructure by providing for the development of new infrastructure. To concentrate on inter -governmental relations by working cooperatively with neighboring jurisdictions. To increase public safety by maximizing fire and the emergency medical services resources and improve and upgrade the City's existing infrastructure. DISCUSSION: These improvements are necessary to service' the proposed Citrus Continuation High School on Citrus Avenue and to encourage annexations to the City of Fontana in the area south of the 1-10 freeway. On December 21, 1999, the City Council authorized staff to advertise for bids for the construction of Citrus Avenue Sewer and Storm Drain from Jurupa Avenue to Slover Avenue. Twenty bids were received by the City Clerk's Office. Bids were then publicly opened by the City Clerk in the Council Chambers at 10:00 AM on July 20, 2000. Staff has determined after detailed review of the bid documents, checking references, bid bond and bid tabulations, that Kenko Inc., dba McGrand and Associates as the lowest responsible bidder. The bid amount of $2,212,515.00 which is approximately 13.90% below the Engineer's estimated construction cost of $2,570,000. 0.111 Item: Page 1 of 2 Staff recommends thward of the construction contract 'Citrus Avenue Sewer and Storm Drain Project from Jurupa Avenue to Slover Avenue to Kenko Inc., dba McGrand and Associates in the amount of $2,212,515.00. With regards to the requested closure for Citrus Avenue, the traffic detour plans for the construction of sewer and street improvements on Citrus Avenue require Citrus Avenue to be closed to through traffic between Jurupa Avenue and Slover Avenue. The local residents and emergency vehicles will be provided access through Santa Ana Avenue and Slover Avenue to enter the effected reach. Beech Avenue will be constructed and.: extended south to Jurupa Avenue for detour traffic. The project on Citrus Avenue will be staged construction between Jurupa and Santa Ana Avenues and between Santa Ana and Slover Avenues. The closure will end as soon as the sewer and storm drain improvement construction work is completed on Citrus Avenue. The contractor will have 90 working days to complete the sewer and storm drain improvement work from the date of issuance of Notice to Proceed. The construction is expected to start or____.“Oc eJ 2, 2000 and to be completed by February 5. 2001. All agencies providing emergency seivices and local residents will be notified by mail and newspaper. The road closure may cause a temporary inconvenience for the citizens but will greatly help in the completion of the project in a fast and efficient manner. FISCAL IMPACT: Designated funds are budgeted in Fiscal Year 2000/01 for the project in Fund 502 Sewer Capital, Fund 426 Storm Drain, and Fund 423 Capital Investment. Funds have been appropriated in a total amount of approximately $1,400,000. This budget amount was based on a prior project proposal to extend facilities to the Citrus Continuation High School. It is recommended that the project scope be modified to extend facilities to just north of Slover Avenue, thereby increasing the project cost. The recommended action will authorize staff to appropriate $994,500 from the fund balance to Sewer Capital Fund 502-53720-8017. MOTION: Approve staff recommendation.
