City Engineer FROM: City Attorney RE: Property Acquisition Status The purpose of this memorandum is to provide you with an update on the various real property and right-of-way acquisition matters being coordinated or handled by our office on behalf of the City of Fontana or the Fontana Redevelopment Agency. We encourage your questions and would be pleased `.to 'discuss any of these matters with you or members of your staff in greater detail. Auto Mall Property Acquisition #17529.0102 The real property appraisals have been completed by Donahue & Company. The appraisal review has been completed by Mason & Mason. We have reviewed both the appraisals and the appraisal review and are attempting to reconcile differences of opinion between the two appraisers. Once this has been accomplished, the appraisals will be submitted to the Agency for approval. Baseline -Almeria Trunk Line/Highland-Haven Proiect (North Fontana) 117529.0400 The sewer reimbursement and detention basin agreements were approved by the City Council on February 16, 1993. Presley has executed and delivered to the City an easement deed for the sewer facilities. Once the deed has been accepted and recorded by the City, we can dismiss the eminent domain action and request that the money deposited as probable just compensation for the sewer '1 easementbereturned to the City. LMH154231 LAW OFFICES OF • • 'BEST, BEST & KRIEGER Empire Center Street Improvement Project #16498.0306 The escrow for purchase of a street and public utilities easement from Five Star Santa Anita Investment Group, et al., closed on February 16, 1993. There has been no further activity with respect to the eminent domain action filed against Rosemead Properties. We will contact the attorneys for Rosemead Properties to determine the basis for their claim for additional compensation for the street and public utility easement. The easement deed for the street and public utility easement needed from the property located at the southwest corner of Jurupa and Sierra Avenues has been presented to the property owners for signature, but has not yet been returned to the City. We understand the deed is still being circulated among the numerous property owners for signature. If for any reason the property owners cannot or will not sign and return the deed to the City on a timely basis, the City can proceed with an eminent domain action to acquire the easement since it adopted a resolution of necessity on November 17, 1992. We will not take this action for the time being since the property owners have indicated a willingness to dedicate the necessary easement. However, the eminent domain action must be filed by May 17, 1993 (or the resolution of necessity rescinded) to avoid exposing the City to a possible claim in inverse condemnation. Fire Station No. 78 #17529.0402 (North Fontana) On or about February 9, 1993, a "Purchase Requisition" was sent to four prospective appraisers to solicit bids for a new appraisal of the proposed fire station property. In the meantime, we are awaiting receipt of the appraisals of the additional rights -of -way needed for construction of roadway improvements for this project, which should be completed within the next week or so. Staff is also working with the City Attorney in notifying property owners of their owner participation rights. I-10 Channel to Valley Boulevard Storm Drain #16498.0172 Pool v f EL, Mr. Kobayashi, the City's right -ply acquisition agent, has been in contact with property ownerCDonal- Lemme in an attempt to reach an agreement for purchase of the storm drain easement, temporary construction easement and temporary access easement needed for this project. A letter summarizing their discussions and making a final offer to purchase the easements was sent by Mr. Kobayashi to Mr. Lemme on February 17, 1993. It is not expected that Mr., Lemme will accept the offer since he has held firm on his desire that the City build a private street over the storm drain easement in compensation for the easements. Not only is the City unwilling to undertake the responsibility of building a private street, but the street Mr. Lemme has in mind would cost in excess of $200,000 to LMH154231 -2- LAW OFFICES OF • • &EST, BEST & KRIEGER build, which is more than $50,000 over the appraised value of the easements. Therefore, Staff has directed that we set this matter for hearing on March 16, 1993, to consider the adoption of a resolution of necessity. Jurupa Avenue Condemnation #16498.0225 Adoption of out -parcel assessments for the calendar year 1992 is tentatively planned for the March 16, 1993, City Council meeting. Once that step has been completed, the City will be in a better position to resolve the property owners' concerns prior to dedicating the necessary easement to the City. Therefore, we will continue to hold off on actively prosecuting the eminent domain action in the hope that these matters can soon be resolved and the litigation disposed of accordingly. Marygold Avenue Street Improvements #16498.0173 This project is still on hold pending execution of the Reimbursement Agreement with Kaiser. Kaiser's attorney has prepared a counter -proposed Reimbursement Agreement, which is being reviewed by the City Attorney. Sierra Avenue and Valley Boulevard Improvements #17529.0503 There has been no further activity with respect to the FFCA/IPI 1985 Property Company and Foodmaker, Inc. transaction. We are preparing a Subordination Agreement for FFCA/IPI's security interest in the property, which we understand is the last item needed in order to close this escrow. GRC's settlement proposal has been approved by the City Council. The settlement documents are being prepared by our office. We are working with Staff to investigate the claims of Galardi Group that the City moved the Der Wienerschnitzel sign during construction, and caused the electric lights on the sign to malfunction. We are also continuing efforts to solicit a demand for settlement from Galardi Group in hopes that this case can be settled short of trial, which is scheduled for June, 1993. On page CA-8 of the bid specifications, in the final paragraph, last sentence, the word "insure" is used instead of the word "inure". This should be corrected. There appear to be no other material errors in the specifications, nor are there any inconsistencies with the Master Plan of Sewer System Reimbursement Agreement as presently drafted. However, this is still subject to the possibility that Presley will move to set aside the City's Order for Possession or to challenge the City's right -to -take the easement within 30 days of being served, as described in our letter of December 29, 1992. At that time, we were also successful in obtaining an order for prejudgment possession which authorizes the City to take possession of the easement 10 days after service of the Order for Possession onthe property owners. Presley of Southern California was served with Summons, Complaint, Order for Possession and related documents on December 23,1992. Therefore, the City will be entitled to possession of the easement on January 3, 1993. However, it is possible that the property owner may challenge the Order for Possession or the City's right to take the easement. While it is unlikely that they will prevail in either case, the risk must be considered prior to the City taking actual possession of the easement and building the works of improvement. I have already received a telephone call from Presley's counsel inquiring as to the reasons the City is proceeding with condemnation. I responded that the City needs possession now in order to complete construction of the sewer project, but that this should have no effect on negotiations for the sewer reimbursement agreement. However, I would not be surprised if Presley attempts to challenge the Order for Possession, contending that it is an attempt by the City to obtain leverage in these negotiations. Because we am now in litigation, it is important that I be kept informed of the status of the negotiations. If you wish to discuss this further or have any questions, please do not hesitate to call.
