CAMACHO hereinafter referred to as "owners", and the CITY OF FONTANA, hereinafter referred to as "City". WHEREAS, Owners are the owners of the real property consisting of approximately 2 gross acres located at 8316 North Citrus and is further described as follows: Lot 2, Tract No. 3926, in the County of San Bernardino, State of California, as per Map recorded in Book 54 of Maps, page 4 of said County. Being further described as Assessor's Parcel Number 232-111-09 Areas and distances computed to street centers. WHEREAS, Owners are developing said real property as under the County of San Bernardino development standards and regulations, but require the use of the City of Fontana sewer system and the right to connect to the existing sewer main which is contiguous to said property; and WHEREAS, Owners are desirous of annexing to the City of Fontana. WHEREAS, the City of Fontana is willing to consent to the connection of said property to the sewer main only on the condition that the property be annexed to the City of Fontana at the earliest possible time; and WHEREAS, the City of Fontana is proceeding with the annexation of Owners' property plus other property, but said annexation will cause delay, which delay would create a substantial hardship for Owners of said property. NOW, THEREFORE, the Party does agree as follows: • Page 2 I. Owners do hereby give their irrevocable consent to annex to the City of Fontana at such time as the annexation may be property approved through appropriate legal proceedings, and Owners do further .•agree to provide all reasonable cooperation and assistance to the City in the annexation proceedings. Said cooperation is contemplated to include'. signing any applications or consent prepared by the City and submitting any evidence reasonably within the control of Owners to the various hearings required for the annexation. Said cooperation does not include,.however', any obligation on behalf of Owners to institute any litigation or judicial.proceedings whatsoever to force•the annexation to the City of Fontana. 2. The City of Fontana does hereby agree to authorize the connection of said property proposed to be developed on Owner's property to the sewer main located in Citrus Street and contiguous with Owner's property. Said connection to the sewer main shall be permitted by City at such time as the development has progressed to the point that sewer connection to the. main would normally occur, and said connection shall be permitted prior to the annexation to the City of the development has reached that stage of development that it is necessary prior to the completion of the annexation procedures. 3. Owners agree to pay such annexation fees and costs and other municipal charges as would ordinarily be charged on the annexation of property to the City. Said fees shall be payable when the same becomes due and payable. 4. Owners shall pay all fees and charges and make all deposits required by City to connect to and use the sewer and owners agree to be bound by all City ordinances, rules and regulations respecting the sewer system. 5. This Agreement shall be recorded. 6. Owners shall install all improvements upon said property to the City's standards as outlined in statement of policy of the County of San Bernardino Board of Supervisors 4-12-76. In the case one or more of these requirements are waived by said County, all omitted improvements shall be completed within two (2) years and thirty (30) days of the completion of Annexation. 7. All fees such as, but not limited to, Parks and Recreation fees and storm drain fees, shall be paid within two (2) years and thirty (30) days of the date of annexation. 8. The owners shall develop such property to City Codes. 9. Owners executes the Agreement on behalf of themselves, their heirs, successors and assigns, and said Agreement shall be irrevocable without the prior written consent of both parties hereto. WITNESSETH: WHEREAS, it is the intention of the Applicant to improve a certain parcel or parcels of land in the City of Fontana described as 8316 Citrus Avenue APN #232-111-09 and, WHEREAS, The City Council of the City has approved and adopted certain rules and regulations governing the developing of land in the City and the posting of improvement securities guaranteeing the installation of necessary permanent improvements as set forth in Article 2 of Chapter 27 of the Fontana City Code, and, WHEREAS, the City Code specifically sets forth the requirements for the installation of necessary improvements affecting the land development. NOW, THEREFORE, the City and the Applicant mutually agree as follows: The Applicant will construct or cause to be constructed at his own cost and expense all necessary permanent improvements on streets abutting his property as specifically described and shown on Drawing No. 65 , and total cost estimate as stated on Exhibit A , which was approved by the City Engineer and filed in his office on May 10, 1991 , and in accordance with applicable provisions of the Standard Specifications and Standard Details of the City of Fontana in effect on the date of this Agreement. The work shall be done under the supervision of and to the satisfaction of the City Engineer. The estimated cost of said work and improvement is the sum of One Thousand Five Hundred ($1,500.00 ). A Surety bond for Faithful Performance in the penal sum of the estimated cost of said work and improvement shall be properly executed in favor of and delivered to the City as a part of this Agreement. In lieu of a surety bond the Applicant may deposit money or negotiable securities with the City as provided in Article 2 of Chapter 27 of the Fontana City Code. The Applicant agrees to complete all work called for under this contract within 60 Days from date hereof. If the work called for under this contract is not finished and completed in all respects within the specified time period, the City Council shall have the right in its discretion to extend the time. If the work is not completed within the specified time period, because of acts of God, the public enemy, the City or because of fire, flood, epidemic, quarantine restrictions, strikes or freight embargoes, the Applicant shall be entitled to an extension beyond the specified time period for a period equal to the length of such delay provided the City Engineer is notified in writing of the cause of the delay within ten days from the beginning of such delay. If an extension of time is granted it shall in no way affect the validity of this contract or release the surety on the bonds attached hereto. Applicant shall defend, indemnify and hold City, its elected officials, officers, employees, and agents free and harmless from any and all liability from loss, damage, or injury to or death of persons or property in any manner arising out of or incident to Applicant's performance of this Agreement, including without limitation all consequential damages and attorney's fees, whether or not resulting from the negligence of Applicant or Applicant's agents. This indemnity shall extend to any claims arising because Applicant has failed to properly secure any necessary easement, land right, contract, and approval, but shall not extend to any claim arising out of the sole negligence of City. It is further expressly agreed that the Applicant will procure all permits and licenses, pay all charges and fees, and give all notices necessary and incident to the due and lawful prosecution of the work.
