Contract Document and Notice to Proceed
Dear Mr. Ramirez:
Enclosed is one copy of the original contract on the above referenced project. The
City of Fontana has fully executed said contract, effective date March 16, 1993, per
City Council approval of the award.
This letter will also serve as the office Notice to Proceed for the above referenced
project.
In addition, this letter will also serve as official notification that the City of Fontana
has reviewed and approved the pump equipment shop drawings (page 1) and the
electrical shop drawings (page 2) for the control panel, MCC and enclosure, etc.
Pursuant to the executed contract document, the manufacturers must supply you with
their certifications as required.
Also brought to your attention is the 8-10 week delivery date as specified by the
manufacturer, Essca (Engineers Sales -Service Company, Inc.)

This letter is to document that on April 13, 1993, the contract documents were returned to
Multi -Construction to correct the insurance certificates as required by the City of Fontana's Risk
Manager. Your immediate response to correct this matter is greatly appreciated.
Also, please find enclosed a copy of the traffic control requirements for this project. Along with
the memorandum dated April 12, 1993, from the City Traffic Engineer, I have enclosed the
cover sheet and price sheet for the Manual of Traffic Controls for Construction and Maintenance
of Work Zones dated 1990. It is suggested that a copy of this manual be on hand at the job site
while construction is underway.

SUBJECT: TAMARIND AVENUE SEWER FORCE MAIN, TRAFFIC CONTROL
DATE: APRIL 12, 1993
The. Traffic Control, signs and traffic control devices for the above
mentioned project shall conform to the Caltrans Manual of Traffic
Controls for Construction and Maintenance Work Zones, latest edition.
A full Traffic Control Plan for this project is not required at this
time. The following is a list of Traffic Control requirements for this
project:
1. Tamarind Avenue and the intersection of Santa Ana and Tamarind
Avenues shall remain open to normal flow of traffic with one 12'
travel lane for each direction of traffic during non working hours.
2. A qualified flagman shall be in place at all times during any lane
closures.
3. Notification shall be given to the emergency, service agencies --
Police Department, Fire Department, Ambulance Company, Com Center,
Colton School District and the affected property owners.
4. There can be no other construction or traffic control which conflict
with this traffic control.
5. The contractor shall adhere to the Caltrans Manual of Traffic
Controls for Construction and Maintenance Work Zones, latest
edition.
6. A minimum 12' lane shall be maintained at all times during
construction.
7. If there should be any change in the construction that might affect
the flow of traffic the ,contractor shall notify the City Engineering
Inspector immediately.

Please be advised that the City of Fontana has as of this date
received two "STOP WORK NOTICES" and are listed as follows:
1. Crane Rental Services: for $3017.50 received by the
City of Fontana on July 28, 1993.
2. R.J. Lalonde, Inc.: for $13,954.50 received by the
City of Fontana on August 10, 1993.
Multi -Construction must clear all outstanding billings not paid to
date with all sub -contractors and rental companies before this
contract can be finalized through the City Council for acceptance
and completion and the "Notice of Completion" can be recorded with
the County Recorders Office.

Compaction Failures
Dear Sir:
Please be advised that the City of Fontana is concerned with the amount of compaction failures
that have occurred onthis project.
Enclosed is written documentation from G.P.I., geotechnfcal engineer on the project, who have
addressed the density failures to be approximately 40 percent of the tests taken on the backfill
for the sewer lift station wet well.
Also, the City is in receipt of the daily reports from G.P.I. dated June 17, 21, and 22 which
indicate that the trench backfill for the sewer force main has also failed and will have to be
retested. Please refer to contract documents Section 211, page SP-12 (specifically, Section 211-
2.2 "Field Density", pages SP-12 and SP-13, more specifically, the last sentence which states
"Retest of areas which have failed compaction will be performed by the Engineer at the
Contractor's expense".
Your immediate attention is requested to correct any unacceptable field construction methods
which cause these failures to occur.

In accordance with your request, we have evaluated the time and fees expended to date, related to our
services on the subject project. We concur with the concerns that progress of the backfill recently
completed resulted in a higher level of effort than is typically required for this type of project.
The backfill required two full weeks to complete, including some ten hour days. Since the excavations was
small in plan dimension, full time presence was required (to test each lift).
Based on estimated dimensions, the excavation backfill consisted of approximately 2500 yards of soil;
therefore, backfill was placed at approximately 250 yards per day: Typical deep (25 feet) trench backfill is
typically placed at rates well in excess of 1000 cubic yards per day. We expended approximately 110 hours
observing and testing the backfill. A copy of the invoice for this project is attached. During the backfill, field
density testing indicated inadequate compaction, resulting in reworking of the soil and retesting. A total.of
33 tests were taken in the backfill. Fourteen of these tests indicated inadequate density. This is a failure
rate of approximately 40 percent. Typically rates of failing tests are less than 10 percent.
Based on our experience, it is our opinion that backfill of this type of excavation should take one week or
less. Manhole excavations, having similar depths, usually take one to two days to backfill.

following listed reasons:
1. Item No.'s listed on progress payment do not agree with the bid line items.
Progress payments must reflect only those line items by number that correspond
to the contract document.
2. The "Backfill and Compaction" line item is being billed at 95% complete.
This does not agree with field investigation and inspector's review as only being
75% complete.
3. The line item "12" DIP FORCE MAIN L.F." is being billed at 75% complete as
of June 23, 1993.
Per inspection reports and field investigation "by stationing" only 50% of this line
item has been installed. Also, in reviewing the compaction, reports for trench
backfill, all test indicated that the 95% compaction is not being met.
4 A Revised Construction Schedule was not submitted with your Progress Payment
No. 2.
Please furnish said revised schedule with each request for payment so as to not
hold up the processing procedures through the City system.
5. The labor classification must be noted on all certified payroll documents as

Dear Mr. Rameriz:
This letter is to document that on April 13, 1993, the contract documents were returned to
Multi -Construction to correct the insurance certificates as required by the City of Fontana's Risk
Manager. Your immediate response to correct this matter is greatly appreciated.
Also, please find enclosed a copy of the traffic control requirements for this project. Along with
the memorandum dated April 12, 1993, from the City Traffic Engineer, I have enclosed the
cover sheet and price sheet for the Manual of Traffic Controls for Construction and Maintenance
of Work Zones dated 1990. It is suggested that a copy of this manual be on hand at the job site
while construction is underway.

SUBJECT: TAMARIND AVENUE SEWER FORCE MAIN, TRAFFIC CONTROL
DATE: APRIL 12, 1993
The Traffic Control, signs and traffic control devices for the above
mentioned project shall conform to the Caltrans Manual of Traffic
Controls for Construction and Maintenance Work Zones, latest edition.
A full Traffic Control Plan for this project is not required at this
time. The following is a list of Traffic Control requirements forthis
project:
1. Tamarind Avenue and the intersection of Santa Ana and Tamarind
Avenues shall remain open to normal flow of traffic with one 12'
travel lane for each direction of traffic during non working hours.
2. A qualified flagman shall be in place at all times during any lane
closures.
Notification shall be given to the emergency service agencies --
Police Department, Fire Department, Ambulance Company, Com Center,
Colton School District and the affected property owners.
4. There can be no other construction or traffic control which conflict
with this traffic control.
5. The contractor shall adhere to the Caltrans Manual of Traffic
Controls for Construction and Maintenance Work Zones, latest
edition.
6. A minimum 12' lane shall be maintained at all times during
construction.
7. If there should be any change in the construction that might affect
the flow of traffic the contractor shall notify the City Engineering
Inspector immediately.

Gentlemen:
On March 16, 1993, the City Council of the City of Fontana approved the contract award to
Multi Construction, Inc. for the above referenced project.
Enclosed you will find three (3) original contract documents that must be executed and returned
to the City of Fontana prior to issuing the notice to proceed. As you are aware, this contract
is on a very tight construction time frame. Your expedient response to return all required
documents is requested.
A pre -construction meeting will be scheduled soon to go over the project in detail. You will be
notified as to the date, time and location of this upcoming meeting.
As you are aware, the City of Fontana is in the process of obtaining a temporary construction
easement for this project from the property owner adjacent to the lift station site. This easement
will be executed prior to the notice to proceed; however, as part of this easement negotiation the
property owner Terminal Freight Handling Company, a Delaware Corporation, Sears Logistics
Services (SLS) 225 Windsor Drive, Itasca, Illinois 60143-1223, is requiring that they be added
as additional insured to all insurance policies as they pertain to this contract. Therefore, please
have your insurance provider include the above referenced parties as additional insured pursuant
to Section 7-3.1 and 7-3.2 of the contact documents.
