RECOMMENDATION: TO APPROVE THE PRELIMINARY ENVIRONMENTAL EXEMPTION ASSESSMENT AND TO DIRECT STAFF TO FILE THE NOTICE OF EXEMPTION. ECONOMIC BENEFIT: 1XXI No I I Yes BUDGET IMPACT: 1 _ I No IXXI Yes Funding Source: 1 _ 1 General Budget I Low/Mod Housing Fund Fund Budget I _ 1 Bond Proceeds II Developer Deposits The connection of private sewer laterals to the City's Sewer system was authorized by the Redevelopment Agency with the adoption in 1991 of the Public Improvement Financing Plan and Implementation Schedule, with funds allocated in the 1993/94 Agency Budget adopted June 22, 1993. Low/Moderate Housing Funds are used for this program. ENVIRONMENTAL IMPACT: No Yes This report is exempt from further environmental review under section 3.13, Class 1 of the Local Guidelines for Implementing the California Environmental Quality Act (1992) as the request is the award of a contract to perform minor modifications to existing homes. A Preliminary Exemption Assessment has been prepared (Page 4), and a Notice of Exemption shall be issued following Council approval. BACKGROUND: The Agency, with the adoption of Public Improvement Financing Plan and Implementation Schedule in 1991, authorized the use of Low/Moderate Housing Funds to provide various improvements to the Highland Haven neighborhood (Location Map, Page 5). Amendment #1 to the Plan clarified what assistance, requirements and criteria apply to specific properties. The first phase of this plan, installation of sewer mains, has been completed and private property owners may now connect to the City's sewer system. On June 22, 1993, the Agency budgeted $331,000 in Housing Funds to assist Highland Haven homeowners with the installation of private sewer laterals. Of the 75 applications received to date, 72 have been processed and qualify for assistance. ANALYSIS AND JUSTIFICATION: A formal bid process was used to request bids for the connection of individual homes to the City's sewer system. Atlas Underground was determined to be the lowest responsive, responsible bidder for the project. Staff recommends that Atlas Underground be awarded the contract in an amount not to exceed $87,888 ($79,$98 bid plus 10% contingency of $7,990), that the Executive Director be authorized to sign the contract and that the Agency authorize the contractor to proceed immediately with the intended work. This recommendation is consistent with adopted purchasing procedures and policies. ALTERNATIVES: In considering this matter, the Redevelopment Agency has several alternatives: 1. a. Award bid for the installation of private sewer laterals for qualifying property owners within the Highland Haven neighborhood in the amount of $87,888 to Atlas Underground. (Staff recommendation) b. Authorize the Executive Director to sign the contract and that the contractor proceed immediately with the intended work. (Staff recommendation) 2. Reject all bids and direct staff to proceed with another Request for Bid for the installation of private sewer laterals in the Highland Haven neighborhood. 3. ENVIRONMENTAL IMPACT: ID Yes IX I No BACKGROUND: The sewer project was constructed by the Fontana Redevelopment Agency to improve infrastructure deficiencies within the Highland Haven neighborhood of North Fontana (Vicinity Map, Page 16). On March 2, 1993 (Page 17), the Fontana Redevelopment Agency accepted the work performed by C.P. Construction Company, Inc. as complete. The City Engineer was authorized at that time to record a Notice of Completion for the project. The Notice of Completion was recorded on March 9, 1993. • 2 • A ANALYSIS AND FINDINGS: Upon completion of a sewer installation project, acceptance by the City Council of the sewers in that project as a part of the City sewer system is required by City Code, Section 26-57 (Page 18). The Redevelopment Agency accepted the project as complete on March 2, 1993 (Page 17). Adoption of the proposed resolution (Pages 3-15) will satisfy the City Code requirement for acceptance of the sewers into the City sewer system, and will ensure maintenance of the system by the City. Staff recommends adoption of the proposed resolution accepting the sewers in the Highland Haven neighborhood of North Fontana, Tract 3348, as a part of the City sewer system. Devere Steve Deitsch City Manager City Attorney • • RESOLUTION NO. 93-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FONTANA ACCEPTING THE SEWERS WITHIN HIGHLAND HAVEN NEIGHBORHOOD OF NORTH FONTANA, TRACT 3348, AS A PART OF THE CITY SEWER SYSTEM. WHEREAS, Section 26-57 of the Code of the City of Fontana provides that each addition to or extension of the sewer system shall be accepted by Resolution of the City Council; and WHEREAS, the Resolution of Acceptance shall contain the terms of any special consideration which shall apply to the sewer so accepted; NOW, THEREFORE, be it resolved by the City Council of the City of Fontana that sewer mains and laterals within and as a part of Highland Haven Neighborhood of North Fontana, Tract 3348, are hereby accepted as a part of the sewer system of this City. The following special consideration shall apply: Under the Highland Haven Sewer System Reimbursement Agreement (Attachment 1), and in accordance with Sections 55 through 58 of Chapter 26 of the Municipal Code, the City will reimburse the Agency the sum of $111,238.51, for upsizing the'Los Cedros Avenue sewer line, within five years following the recordation of the Notice of Completion, but not later than June 30, 1988. In addition, the City will administer the collection of the proportionate share cost of $2,925.66 (at the time property owners apply for connection rights) in accordance with Sections 26-31.1, 26-31.3 and 26-31.5 of the Municipal Code. The City will then reimburse the Agency any proportionate share cost funds collected by the City from property owners served by the Highland Haven Sewer. Any funds reimbursed to the Agency will be deposited into the Agency's North Fontana Low/Moderate Income Housing Fund. The Agency will be responsible for notifying the City of those property owners who meet the low and moderate income waiver criteria, and for those property owners who must pay the pro rata share. NOW, THEREFORE, in consideration of the mutual covenants contained herein, City and Agency hereby agree as follows: AGREEMENT 1. Definitions. 1.1 "Agency" shall mean the Fontana Redevelopment Agency, a public body corporate and politic. ATTACHMENT 1 • • GCl426699 1.2 "Agreement" shall mean this Highland Haven Sewer Reimbursement Agreement between the City of Fontana and Fontana Redevelopment Agency. 1.3 "City" shall mean the City of Fontana, a municipal corporation. 1.4 "Code" shall mean the Municipal Code of the City of Fontana. 1.5 "Highland Haven" shall mean that neighborhood generally located west of Citrus Avenue, south of Highland Avenue, north of Walnut Avenue and east of Knox Avenue within the City of Fontana (Tract #3348). 1.6 "Local Sewer Facilities" shall mean sewer facilities with sewer pipe constructed eight (8) inches in inside diameter and appurtenant structures of a size and construction required of a standard local sewer system as defined in Chapter 26 of the Code. 1.7 "Low and Moderate Income Criteria "shall mean that level of low and moderate income as defined in Health and Safety Code Section 50093. 1.8 Master Planned Sewer Facilities" shall mean sewer facilities with sewer pipe constructed in excess of eight (8") inches in inside diameter and appurtenant structures of a size and construction greater than those minimally required of a standard local sewer system as defined in Chapter 25 of the Code. 1.9 "Project" shall mean the construction of Local and Master Planned Sewer Facilities in Highland Haven including construction of partial sewer house laterals as shown on Exhibit "A", attached hereto, and incorporated herein. 1.10 "Project Cost Analysis" shall mean the total actual cost bill submitted to the City as shown as Exhibit "B" attached hereto and incorporated herein by reference. 1.11 "Property" or "Properties" shall mean those 335 parcels of land within Highland Haven which are serviced by the Project. '1.12 "Property Owner" shall mean the legal owner of a Property or Properties located within Highland Haven which is serviced by the Project as defined herein. 1.13 "Property Owner's Annual Income" -shall mean a determination of the" income of a Property Owner for purposes of Health and Safety Code Section 50093. 1.14 "Proportionate Share Cost" shall mean that share of construction costs attributable to each Property serviced by the Project. 2. Sewer,Prolect Construction. 2.1 On December 31, 1992, Agency completed construction of the Project in Highland Haven which Project involved the installation of manholes, laterals, and gravity sewer mains, including one sewer main which was upsized to a City Master Planned Sewer Facility in order to accommodate future development to the north of Highland Haven and on March 9, 1993, Agency filed a Notice of Completion with the County Recorder. -2- • • . GCH26695 2.2 During construction of Project, City, at Agency's expense, provided construction inspection and management services in order to ensure that all work performed by Agency's contractor on the Project was performed in strict compliance with City approved plans, specifications and contract documents. 3. Costs and Assessment of Fees. 3.1 Agency has expended $1,091,333,29 in unaudited North Fontana Low/Moderate Income Housing Funds to cover all costs associated with construction and installation of Project including without limitation engineering, design, construction surveying, soils testing, inspection, management and administration as described in Exhibit "B" attached hereto and incorporated herein by reference. 3.2 City and Agency's engineers have calculated that the difference in cost of constructing Local Sewer Facilities and the cost of constructing Master Planned Sewer Facilities equals $111,238.51. 3.3 City and Agency's engineers have determined that the unaudited cost of the Project less' upsizing costs is $980,094.78 of which 335 Properties in Highland Haven will have benefitted from construction of the Project. Each Properties' portion of costs is determined by dividing the above cost by the total number of Properties to be served (335) which results in a Proportionate Share Cost attributable to each Property of $2,925.66. 3.4 In accordance with the provisions of the Code, Section 26-31.1 to 26- 31.6, the Proportionate Share Cost charged to each Property as described in Section 3.3 above shall be adjusted for inflation pursuant to the Construction Cost Index as published in the Engineering News Record Construction Cost Index (ENRCCI). 3.5 Agency has filed the Notice of Completion for the Project and the City has formally accepted the sewer lines into City's sewer system. Agency has prepared a Project Cost Analysis as shown on Exhibit "B" for City's review , and said Project Cost Analysis has been reviewed and confirmed by City's Engineer and Agency's Engineer. 3.6 Upon formal acceptance by City of Agency's Project Cost Analysis, City shall commence assessment of the Proportionate Share Cost attributable to each Property benefitting from the Project at the time a Property Owner applies for a permit to connect to City Sewer Facilities. 4. Administration of Proportionate Share Cost. 4.1 Subsequent to connection of the Project to the Baseline/Almeria Trunk Sewer, City shall administer the collection of the Proportionate Share Cost attributable to each Property served by the Project, in keeping with Sections 26.31.1, 26.31.3 and 26.31.5 of. the Code. 4.2 City shall refer each Property Owner seeking a permit to connect t.o City Sewer Facilities to Agency for confirmation of Property Owner's Annual Income. 4.3 - Agency shall verify to City in writing when a Property Owner meets Low/Moderate Income Criteria and for whom payment of the Proportionate Share Cost -3- • • shall be deemed to have been paid by Agency so that City shall have no obligation to reimburse Agency for that Property Owner's Proportionate Share Cost. 4.4 Agency shall notify City in writing when a Property -Owner does not meet Low/Moderate Income Criteria so that the Property Owner shall pay to City his or her Proportionate Share Cost of the Project. 4.5 In the event Agency has verified in writing to City that a Property Owner has met Low/Moderate Income Criteria, and if the Property Owner is required pursuant to the Agency's Public Improvement, Financing and Implementation Schedule, the Property Owner shall execute a deed restriction which shall require that the Property assisted by Low and Moderate Income. Housing Funds shall remain available at.affordable housing costs to persons and families of low or moderate income or very low income households as provided in Health and Safety Code Section 33334.3 and shall cause said deed restriction to be recorded with the County Recorder. 4.6 Collection of the Proportionate Share Cost for each Property under this Agreement shall be administered jointly by•the Redevelopment and Housing Director for Agency and the Community Development Director for City to facilitate collection of Proportionate Share Cost payments by City and City's subsequent. reimbursement of those payments to Agency. 4.7 At the time a Property Owner applies to connect to City Sewer Facilities, City shall assess the Property Owner his/her Proportionate Share Cost which shall, upon collection, be posted by City directly to a separate revenue account in the Sewer Capital Fund and .such receipts shall be transferred to Agency on a monthly basis as part of the month end closing activity. 5. Timing of Reimbursement. 5.1 Subject to City's exercise of discretion in making annual budget allocations, City shall reimburse Agency that portion of the total cost of the Project attributable to the difference in the cost of constructing Local Sewer Facilities and the cost of constructing Master Planned Sewer Facilities as provided for in Section 3.2 of this Agreement and shown on Exhibit "B" from City's Sewer Capital Improvement Fund (071) within five years following the recordation of the Notice of Completion. for the Project and formal acceptance of the Project by City or na later than June 30, 1998, whichever occurs last. 5.2 City shall reimburse Agency all Proportionate Share Cost funds collected by City from Property Owners served by the Project who apply for a permit to connect to City Sewer Facilities by posting Proportionate Share Cost payments directly to a separate revenue account in the Sewer Capital Fund and transferring such receipts to Agency on a monthly basis as part of the month end closing activity as provided in Section 4.7 above. 6. Term. 6.1 This Agreement shall continue in full force and effect from and after the date of its execution until all 335 Properties to be serviced by the Project have connected to the Project and City has reimbursed Agency for all Proportionate Share Cost funds collected by City and all upsizing costs unless GCM26695 i • both City and Agency agree, and provide each party with thirty (30) days written notice of, the parties' intention to terminate this Agreement. 7. Entire Agreement. 7.1 This Agreement contains the entire Agreement of the parties hereto with respect to the matters contained herein, and supersedes all negotiations, prior discussions and preliminary agreement or understandings, written or oral. No waiver or modification of this Agreement shall be binding unless consented to by both parties in writing. 8. Notice. 8.1 All notices permitted or required under this Agreement shall be deemed made when delivered to the applicable party's representative as provided, in this Agreement. FRA 93-10 A RESOLUTION OF THE FONTANA REDEVELOPMENT AGENCY APPROVING AMENDMENT NO. 1 TO THE PUBLIC IMPROVEMENTS FINANCING PLAN AND IMPLEMENTATION SCHEDULE FOR THE HIGHLAND HAVEN TARGET AREA (NORTH FONTANA REDEVELOPMENT PROJECT AREA). WHEREAS, on September 15, 1991, the Redevelopment Agency '(the "Agency") adopted Resolution No. FRA 91-63 approving the Public Improvements Financing Plan and Implementation Schedule (the "Plan") for the Highland Haven Target Area within the North Fontana Redevelopment Project Area and authorizing staff to take all appropriate actions in order to implement the Plan; and WHEREAS, the Plan provides for the waiver of the per parcel proportionate share cost of the Highland Haven sewer for any low or moderate income homeowner (owner occupant or investor owner) desiring to connect his/her property to such sewer and willing to execute and have recorded a deed restriction on his/her property, restricting the use of such property to low/moderate income households; and WHEREAS, the Plan requires that those homeowners not meeting the low/moderate income standards and owners of vacant property (regardless of income) desiring to connect to the Highland Haven sewer, pay their per parcel proportionate share of cost of such sewer; and WHEREAS, the Agency desires to amend the Plan to modify the criteria under which the waiver of per parcel proportionate share costs of the Highland Haven Sewer will be considered and appropriate recorded deed restrictions will be required; and WHEREAS, it is necessary and appropriate that this Resolution be adopted. NOW, THEREFORE, be it resolved, determined and ordered by the Fontana Redevelopment•Agency as follows: Section 1. The Fontana Redevelopment Agency approves the amendment No. 1 to the Public Improvement Financing Plan and Implementation.Schedule for the Highland Haven Target Area within the North Fontana Redevelopment Project Area as outlined in Exhibit "A" of this Resolution. The City will.- also re.i mburse the Agency all proportionate share payments collected from property owners connecting to the Highland Haven local sewer system by posting payments directly-io"a separate revenue account in the Sewer Capital Fund and transferring such receipts to the Agency on a monthly basis as part of the month end closing activity. Since the Agency has already expended funds to -complete the improvements in Highland Haven, the Amendment No. 1 to the. Financing Plan and Implementation Schedule will not have an additional cost impact on the Agency's budget. However, for those persons who do not qualify for a waiver of the sewer pro rata share of the costs, they will be required to pay their share at the time of sewer hook-up. The funds collected will be transferred to the North Fontana low/moderate income housing fund. • 2 ENVIRONMENTAL IMPACT: 1771 No I_ Yes The Proposed Agreement and Amendment do not constitute projects under the California Environmental Quality Act. BACKGROUND: On September 3, 1991, the Agency approved a Public Improvement Financing Plan and Implementation Schedule which provided for the installation of sidewalks, sewer and storm drain improvements using 20% low and moderate housing set -aside funds within the Highland Haven Target Area of North Fontana which would be constructed in two phases (Page 8). The 20% set -aside funds are restricted in use to increase or improve housing or related public improvements for low and moderate income persons (Page 9). In order to insure that property owners who, are not low and moderate income pay their fair share of the cost of the improvements, the Plan included the following essential elements: a) that the cost to construct the sewer system be spread over the benefitting properties to arrive at a per parcel pro rata share of such costs; b) any low and moderate income person meeting the program criteria would receive a waiver of their share of.the fee; c) that the City, would by amendment to the City Code,..develop-a mechanism for' requiring reimbursement of the per parcel pro rata share of the cost of the sewer. system by any property owner requesting to hook-up to the sewer system. On September 15, 1992, the City Council approved Ordinance No. 1060 amending Chapter 26 of the Municipal Code by adding new sections, several of which pertain to the construction of local sewer systems by the City and reimbursement to the City of its construction costs thereof (Page 10). Property owners connecting to a local sewer system shall pay a proportionate share' of such cost in addition to all other sewer fees and charges. On December 31, 1992, the Agency completed construction of the local sewer system which included the installation of 8" sewer mains, partial house connection laterals, and the upsizing of one Main- line -located on Los-Cedros Avenue to connect to the master trunk line along,Almeria,=Avenue to -accommodate future development to the north and east of Highland Haven (see map of area,.Page 11). On March 9, 1993, the. notice: of .completion: for the project was =flied with the -San Bernardino County Recorder..: ANALYSIS AND FINDINGS: Proposed Sewer System Reimbursement Agreement The Agency has expended a total of $1,091,333.29 in North Fontana Low and Moderate Income Housing Funds to cover all costs associated with constructing the local sewer. Of this $1,091,333.29, the City Engineer has calculated that $111,238,51 of the total project cost is attributed to upsizing the main sewer line on Los Cedros Avenue to accommodate development to the north and east of Highland Haven. The Agency is eligible to receive reimbursement from the Sewer Fund. The Agency's engineer, J.F. Davidson Associates, Inc., and the City Engineer has determined and confirmed, that the remaining net cost (after City reimbursement to Agency) of the sewer to be proportionally distributed amongst 3 the 335 benefitting properties is $980,094.78 or $2,925.66 per parcel ($980,094.78 _ 335) (Pages 12 through 15). Under the proposed Highland Haven Sewer System Reimbursement Agreement (Page 17) and in accordance with Sections 55 thru 58 of Chapter 26 of the Municipal Code, the City will reimburse the Agency the sum of $111,238.51, for upsizing the Los Cedros Avenue sewer line, within five years following the recordation of the Notice of Completion, but not later than June 30, 1998. In addition, the City will administer the collection of the proportionate share cost of $2,925.66 (at the time property owners apply for connection rights) in accordance with Sections 26-31.1, 26-31.3 and 26-31.5 of the Municipal Code. The City will then reimburse the Agency any proportionate share cost funds collected by the City from property owners served by the Highland Haven Sewer. Any funds reimbursed to the Agency will be deposited into the Agency's North Fontana Low/Moderate Income Housing Fund. The Agency will be responsible for notifying the City of those property owners who meet the low and moderate income waiver criteria, and for those property owners who must pay the pro rata share. Proposed Amendment to Financing Plan and Implementation Schedule The approved Public Improvements Financing Plan and Implementation Schedule requires those homeowners not meeting the low and moderate income standards and all owners of vacant parcels, regardless of income, to pay their proportionate share of the cost of the Highland Haven Sewer, and all other appropriate sewer fees and charges, prior to receiving a permit to connect to the sewer. This provision does not take into consideration that there may be absentee homeowners;, who do not meet thelow and moderate income criteria, but who rent their dwellings to low and moderate income persons. Under these circumstances the proportionate share cost is more than likely to be passed on to the tenants in the form of higher rents. Likewise the provision does not take into consideration that there may be owners of vacant parcels willing to develop affordable housing in accordance with the necessary property deed restrictions. In order to help facilitate the retention and creation of affordable housing units in Highland Haven for low and/or moderate income households, staff is recommending that the Public Improvements Financing Plan and Implementation Schedule be amended to incorporate the following modifications. 1. Owners of vacant land who enter into Owner Participation Agreements (OPA4 with the Agency to develop affordable for rent or for sale housing for "low and moderate income persons and who execute and have recorded appropriate deed restrictions on their property (restricting the use of such property to low and moderate income persons) shall have. their proportionate share cost of.the Highland Haven sewer waived. 2. Absentee homeowners, who do not meet the low and moderate income standards but who rent or lease their property to low and moderate income tenants, and execute and have recorded appropriate deed restrictions, (restricting the use of such property to low and moderate income persons) shall have their proportionate share cost of the Highland Haven sewer waived. • 4 • 3. Low and moderate income homeowners (owner occupant or investor owner) who receive a waiver of their proportionate share cost of the Highland Haven sewer, will be required to execute and have recorded an appropriate deed restriction (restricting the use of their property to low and moderate income persons), if the amount of the proportionate share cost when added to the cost of rehabilitation, if funded with Agency housing funds, equals or exceeds 20 percent of the fair market value of the property. Item A1: 10 of the 51, potholes, for location of existing utilities,involved storm drain crossings and a percentage (25%) of that cost should be allocated to storm drain .costs. 2. Item A2: Clearing and grubbing was performed for the installation of storm drain as well as sewer, and an allocation of 18% should be applied to the storm drain costs. The 18% was arrived at by taking a ratio of the lengths of pipes involved. 3. Item A3: Sawcut and remove existing pavement was likewise performed and should be applied as in item 2 above. 4. Item A4: Replacement of asphalt concrete pavement should be applied per item 2 above. 5. Item A5: Trenching, sheeting and shoring should be applied per item 2 above. 6. Item A27: The cost of the installation of the barricades should be split evenly between the two installations. 7. Item A30: 18% of the cost of the change order, for the additional pavement overlay, should be appiied to the storm drain costs (See Item 2 above). The total cost attributable to the sewer installation is $980,094.78 to be allocated to 335 lots benefitting; therefore, the proportionate sewer installation share is $2,928.00 per lot. RECITALS WHEREAS, Agency has constructed local and master planned sewer facilities including partial house laterals ("Sewer Facilities") in that neighborhood known as Highland Haven within the area subject to the Redevelopment Plan for the North Fontana Redevelopment Project and, for this purpose, Agency used. North. Fontana Redevelopment Project Low/Moderate Income Housing Funds pursuant to California Health and Safety Code Section 33334.2 et sew.; and WHEREAS, as a condition of construction of the Sewer Facilities, City required Agency to construct a portion of the Sewer Facilities as master planned sewer facilities; and WHEREAS, Chapter 26 the Code of the City of Fontana provides that the City may reimburse any party (1) for the costs of construction of oversized or master planned sewer facilities over and above the costs of local sewer facilities and (2) for construction of local sewer facilities from funds collected by the City . from.those properties benefitted from construction of the facilities; and • WHEREMZWX. trOLIStiggigeiietirifirtirffaiaeiriint iici (4 II ta• :,. , reimburse `Agency aP�- $1II 238`.a �:•f�#r th ca of 'upsyzing Local Sewer— Faittiesa a Mate Pl`anrted S44 iett 'fie ran WHEREAS, City also proposes to collect from owners of properties benefitted by the Sewer Facilities, and pay to Agency, funds equal to that portion of Sewer Facilities construction costs which are attributable to the benefit conferred upon such properties by the construction of the Sewer Facilities; and WHEREAS, the collection of Sewer Facilities costs shall be waived for those properties verified by Agency as meeting Low/Moderate Income criteria as defined in Health and Safety Code Section 50093; and WHEREAS, sewer availability to the Highland Haven properties will not be available until City constructs the Baseline/Almeria Trunk Sewer Project. NOW, THEREFORE, in consideration of the mutual covenants contained herein, City and Agency hereby agree as follows: AGREEMENT 1. Definitions. 1.1 "Agency" shall mean the Fontana Redevelopment Agency, a public body corporate and politic. ' GCH26695 • . GCM26695 1.2 "Agreement" shall mean. this Highland Haven Sewer Reimbursement Agreement between the City of Fontana and Fontana Redevelopment Agency. 1.3 "City" shall mean the City of Fontana, a municipal corporation. 1.4 "Code" shall mean the Municipal Code of the City of Fontana. 1.5 "Highland Haven" shall mean that neighborhood generally located west of Citrus Avenue, south of Highland Avenue, north of Walnut Avenue and east of Knox Avenue within the City of Fontana (Tract #3348). 1.6 "Local Sewer Facilities" shall mean sewer facilities with sewer pipe constructed eight (8) inches in inside diameter and appurtenant structures of a size and construction required of a standard local sewer system as defined in Chapter 26 of the Code. 1.7 "Low and Moderate Income Criteria "shall mean that level of low and moderate income as defined in Health and Safety Code Section 50093. 1.8 Master Planned Sewer Facilities" shall mean sewer facilities with sewer pipe constructed in excess of eight (8") inches in inside diameter and appurtenant structures of a size and construction greater than those minimally required of a standard local sewer system as defined in Chapter 26' of the Code. 1.9 "Project" shall mean the construction of Local and Master Planned Sewer Facilities in Highland Haven including construction of partial sewer house laterals as shown on Exhibit "A", attached hereto, and incorporated herein. 1.10 "Project Cost Analysis" shall mean the total actual cost bill submitted to the City as shown as Exhibit "B" attached hereto and incorporated herein by reference. 1.11 "Property" or "Properties" shall mean those 335 parcels of land within Highland Haven which are serviced by the Project. 1.12 "Property Owner" shall mean the legal owner of a Property or Properties located within Highland Haven which is serviced by the Project as defined herein. 1.13 "Property Owner's Annual Income" shall mean a determination of the income of a Property Owner for purposes of Health and Safety Code Section 50093. 1.14 "Proportionate Share Cost" shall mean that share of construction costs attributable to each Property serviced by the Project. 2. Sewer Prolect Construction. 2.1 On December 31, 1992, Agency completed construction of the Project in Highland Haven which Project involved the installation of manholes, laterals, and gravity sewer mains, including one sewer main which was upsized to a City Master Planned Sewer Facility in order to accommodate future development to the north of Highland Haven and on March 9, 1993, Agency filed a Notice of Completion with the County Recorder. -2- • • GCM26695 2.2 During construction of Project, City, at Agency's expense, provided construction inspection and management services in order to ensure that all work performed by Agency's contractor on the Project was performed in strict compliance with City approved plans, specifications and contract documents. 3. Costs and Assessment of Fees. 3.1 Agency has expended $1,091,333,29 in unaudited North Fontana Low/Moderate Income Housing Funds to cover all costs associated with construction and installation of Project including without limitation engineering, design, construction surveying, soils testing, inspection, management and administration as described in Exhibit "B" attached hereto and incorporated herein by reference. 3.2 City and Agency's engineers have calculated that the difference in cost of constructing Local Sewer Facilities and the cost of constructing Master Planned Sewer Facilities equals $111,238.51. 3.3 City and Agency's engineers have determined that the unaudited cost of the Project less upsizing costs is $980,094.78 of which 335 Properties in Highland Haven will have benefitted from construction of the Project. Each Properties' portion of costs is determined by dividing the above cost by the total number of Properties to be served (335) which results in a Proportionate Share Cost attributable to each Property of $2,925.66.. 3.4 In accordance with the provisions of the Code, Section 26-31.1 to 26- 31.6, the Proportionate Share Cost charged to each Property as described in Section 3.3 above shall be adjusted for inflation pursuant to the Construction Cost Index as published in the Engineering News Record Construction Cost Index (ENRCCI). 3.5 Agency has filed the Notice of Completion for the Project and the City has formally accepted the sewer lines into City's sewer system. Agency has prepared a Project Cost Analysis as shown on Exhibit "B" for City's review , and said Project Cost Analysis has been reviewed and confirmed by City's Engineer and Agency's Engineer. 3.6 Upon formal acceptance by City of Agency's Project Cost Analysis, City shall commence assessment of the Proportionate Share Cost attributable to each Property benefitting from the Project at the time a Property Owner applies for a permit to connect to City Sewer Facilities. 4. Administration of Proportionate Share Cost. 4.1 Subsequent to connection of the Project to the Baseline/Almeria Trunk Sewer, City shall administer the collection of the Proportionate Share Cost attributable to each Property served by the Project, in keeping with Sections 26.31.1, 26.31.3 and 26.31.5 of the Code. 4.2 City shall refer each Property Owner seeking a permit to connect to City Sewer Facilities to Agency for confirmation of Property Owner's Annual Income. 4.3 - Agency shall verify to City in writing when a Property Owner meets Low/Moderate Income Criteria and for whom payment of the Proportionate Share Cost -3- • • GCM26695 shall be deemed to have been paid by Agency so that City shall have no obligation to reimburse Agency for that Property Owner's Proportionate Share Cost. 4.4 Agency shall notify City in writing when a Property Owner does not meet Low/Moderate Income Criteria so that the Property Owner shall pay to City his or her Proportionate Share Cost of the Project. 4.5 In the event Agency has verified in writing to City that a Property Owner has met Low/Moderate Income Criteria, and if the Property Owner is required pursuant to the Agency's Public Improvement, Financing and Implementation Schedule, the Property Owner shall execute a deed restriction which shall require that the Property assisted by Low and Moderate Income Housing Funds shall remain available at.affordable housing costs to persons and families of low or moderate income or very low income households as provided in Health and Safety Code Section 33334.3 and shall cause said deed restriction to be recorded with the County Recorder. 4.6 Collection of the Proportionate Share Cost for each Property under this Agreement shall be administered jointly by•the Redevelopment and Housing Director for Agency and the Community Development Director for City to facilitate collection of Proportionate Share Cost payments by City and City's subsequent reimbursement of those payments to Agency. 4.7 At the time a 'Property Owner applies to connect to City Sewer Facilities, City shall assess the Property Owner his/her Proportionate Share Cost which shall, upon collection, be posted by City directly to a separate revenue account in the Sewer Capital Fund and such receipts shall . be transferred to Agency on a monthly basis as part of the month end closing activity. 5. Timing of Reimbursement. 5.1 Subject to City's exercise of discretion in making annual budget allocations, City shall reimburse Agency that portion of the total cost of the Project attributable to the difference in the cost of constructing Local Sewer Facilities and the cost of constructing Master Planned Sewer Facilities as provided for in Section 3.2 of this Agreement and' shown: on Exhibit "B" from City's Sewer Capital. Improvement Fund (071) within five years following the recordation of the Notice of Completion. for the Project and formal acceptance of the Project by City or no later than June 30, 1998, whichever occurs last. 5.2 City shall reimburse Agency all Proportionate Share Cost funds collected by City from Property Owners served by the Project who apply for a permit to connect to City Sewer Facilities by posting Proportionate Share Cost payments directly to a separate revenue account in the Sewer Capital Fund and transferring such receipts to Agency on a monthly basis as part of the month end closing activity as provided in Section 4.7 above. 6. Term. 6.1 This Agreement shall continue in full force and effect from and after the date of its execution until all 335 Properties to be serviced by the Project have connected to the Project and City has reimbursed Agency for all Proportionate Share Cost funds collected by City and all upsizing costs unless -4- • • both City and Agency agree, and provide each party with. thirty (30) days written notice of, the parties' intention to terminate this Agreement.. 7. Entire Agreement. 7.1 This Agreement contains the entire Agreement of the parties hereto with respect to the matters contained herein, and supersedes all negotiations, prior discussions and preliminary agreement or understandings, written or oral. No waiver or modification of this Agreement shall be binding unless consented to by both parties in writing. 8. Notice. 8.1. All notices permitted or required under this Agreement shall be deemed made when delivered to the applicable party's representative as provided in this Agreement. The total adjusted contract amount awarded to C.P. Construction is $1,143,650. All public works contracts provide for a 10% retention of the total contract amount. A 5% retention has already been released to the contractor pursuant to Section 9.3.2 of the Standard Specifications for Public Works contracts (Page 3). The remaining 5% will be released to the contractor 35 days after acceptance of the work by the Agency and a Notice of Completion for the Project has been recorded with the County. ENVIRONMENTAL IMPACT: IXXI No I _1 Yes A Negative Declaration for this project was adopted by the Agency on June 5, 1990 (Page 4). Additionally, the project is consistent with the objectives of the North Fontana Redevelopment Plan. BACKGROUND: On September 17, 1991, the Agency authorized staff to advertise for bids for the construction of sewer and storm drain improvements (Phase I) in the Highland Haven Target Area (Page 5). • 2 On May 7, 1992 at 2:00 p.m., fourteen bids to construct sewer and storm drain improvements in the Highland Haven Target Area were opened by the City Clerk. Upon reconciliation of the bid documents and checking the bid proposals, staff confirmed that C.P. Construction., Inc., was the lowest responsible bidder (Page 6) On June 2, 1992, the Redevelopment Agency accepted a bid in the amount of $1,063,920.25 and awarded a Contract to C.P. Construction Co., Inc., for the construction of sewer and storm drain improvements in the Highland Haven Target area (Page 10). During the course of construction there was one (1) change order totaling $79,729.75, bringing the total construction cost to $1,143,650. This change order represents an increase of 7.49% over the original contract amount. The change order was necessary to accommodate an increase in the required quantity of asphalt concrete pavement resulting from varying asphalt thickness in the existing pavement and adjustments in the contract item to conform with field measured quantities. ANALYSIS AND FINDINGS: The City's Community Development Department, Engineering staff provided the necessary Project construction management and inspection and have determined that the Project has been constructed per City standards. The City Engineer has also verified that the Project has been completed according to contract plans and specifications. Therefore, staff recommends that the Agency accept as complete the work performed by C.P. Construction Co., Inc., (construction of sewer and storm drain improvements) in the Highland Haven Target Area. After 50 percent of the Work has been completed and if progress on the Work is satisfactory, the deduction to be made from the re- maining progress estimates and from the final estimate may be 'limited to $500 or 10 percent of the first half of the total Con- tract amount, whichever is greater. No progress payment made to the Contractor or its sureties will constitute a waiver of the liquidated damages ,under Subsection 6-9. As provided for in Sections 10263 and 22300 of the Cali- fornia Public Contract Code/ the Contractor may substitute securities for any monies withheld by the Agency to ensure performance under the Contract. 9-3.3 Delivered Materials. When provided for in the Specifications, and subject to the limitation and conditions therein, the cost of materials and equipment delivered but not in- corporated in the Work will be included in the progress estimate. 9-3.4 Mobilization. When a bid item is included in the Proposal form for mobilization and subject to the conditions and limitation in the Specifications, the costs of work in advance of construction operations and not directly attributable to any specific bid item will be included in the progress estimate. The following specifications set forth the requirements for crushed rock, rock dust, gravel, sand and stone for riprap. Sieve analyses and sand equivalents shall be determined as prescribed in Section 211. All rock products shall be clean, hard, sound, durable, uniform in quality, and free of any detrimental quantity of soft, friable, thin, elongated or laminated pieces, disintegrated material, organic matter, oil, alkali, or other deleterious sub- stance. Unless otherwise specified, all percentages referred to in this Section 200 shall be determined by weight. 200-1.2 Crushed Rock and Rock Dust. Crushed rock and rock dust shall be the product of crushing rock or gravel. The portion of the material that is larger than will pass a %- inch sieve shall contain at least 50 percent of particles having three or more fractured faces. BACKGROUND: The purpose of the recommended public hearing is to consider an Ordinance amending Chapter 26 of the Municipal Code to consider several issues related to sewers within the City. Specifically: 1. The City's present practice when constructing master plan of sewer projects is to construct the house connection sewer or "stub -out" past the existing edge of pavement or curbing whenever a reasonable determination can be made as to a future sewer hook up location. At the time of connection, the property owner is responsible for the cost of the portion of sewer which serves that specific property and is responsible for reimbursing the City for funds advanced for construction. The proposed addition to the City Code would codify the practice. Additionally, the current Code requires the property owner to maintain the portion of the sewer lateral within public right-of-way.. The proposed amendment to the City Code would codify the City's responsibility for maintenance and the property owner's responsibility for maintenance as per current City policy (Page 3). 2 2) On September J, 1991, the Redevelopment Agency approved a Public Improvement Financing Plan and Implementation Schedule which provided for the installation of sidewalks, sewer and storm drains improvements using tax increment 20% low/moderate housing set -aside funds within the Highland Haven Target Area of North Fontana (Page 4). The 20•G set -aside funds are restricted in use to increase or improve housing or related public improvements for low and moderate income persons. In order to assure that property owners who are not low/moderate income pay their fair share of the cost of the improvements, the Plan included the following essential elements: a) that the cost to construct the sewer system be spread over the benefitting properties to arrive at a per parcel pro rata share of such costs (any low & moderate income person meeting the program criteria would receive a waiver of their share of the fee); b) that the City, through legislative enactment (amendment to the City Code), provide a mechanism for requiring reimbursement of the per parcel pro rata share of the cost of the sewer system by any property owner requesting to hook up to the sewer system. The amendment to the code will enable implementation of this action. On July 16, 1991.the City of Fontana and City of Rialto entered into an agreement to provide sewer service for the area south of Interstate 10 and east of Sierra Avenue. This area is outside the Chino Basin Municipal Water District. In order to provide sewer service in a timely manner to this area, particularly, to facilitate development of Palm Court (Empire Center Phase I) a Sewer Service Agreement that defines each party's respective obligations andresponsibilities is necessary. The proposed code amendment will allow the City to pass through to the City of Rialto developer sewer collection and treatment fees required by the City of Rialto in accordance with the Agreement. This action is similar to the connection charge policy currently used for areas within the Chino Basin Municipal Water District. Accordingly, staff recommends that the City Council set the public hearing date for September 1, 1992 to consider amendment to the City Code as outlined above. ENVIRONMENTAL IMPACT: I_I Yes IXXI No A Negative Declaration for this project was adopted by the Agency on June 5, 1990. Additionally, the project is consistent with the objectives of the North Fontana Redevelopment Plan. BACKGROUND: In September of 1989, the Agency authorized Staff to retain the services of J.F. Davidson Associates, Inc., to prepare a report which would outline the housing conditions and infrastructure deficiencies within the Highland Haven neighborhood of North Fontana. Highland Haven is located south of Highland Avenue, north of Baseline Road, west of Citrus Avenue and east of Almeria (Page 24.). Since 1989, staff has been holding evening (as needed) meetings with the 2 • Highland Haven Target Area Committee which is comprised of twelve volunteer members. The members have provided assistance and guidance to staff and consultants in determining the needs within the community. On June 5, 1990, the Agency approved a Housing and Infrastructure Revitalization Program for Highland Haven based on J.F. Davidson's final report and authorized Staff to develop and prepare a comprehensive financing plan and implementation schedule for the Program (Page 7). On November 6, 1990 the Agency authorized the execution of a Consultant Services Agreement with J.F. Davidson Associates, Inc., to prepare plans and specifications for certain public improvements identified in the June 5, 1990 Housing and Infrastructure Revitalization Program. The Agency also made certain findings with respect to the use of tax increment 20% set -aside funds for the design and construction of these public improvements (Page 8). On September 3, 1991 the Agency approved a Public Improvements Financing Plan and Implementation Schedule and authorized Staff to take all appropriate actions to implement the Plan in accordance with the Housing and Infrastructure Revitalization Program for Highland Haven (Page 9). On September 17, 1991 the Agency authorized Staff to advertise for bids the construction of sewer and storm drain improvements (Phase I) in the area (Page 10). On May 19, 1992, the City Council set a public hearing dated June 2, 1992 which is necessary to consider this project (Page 11). ANALYSIS AND JUSTIFICATION: In accordance with Redevelopment Law, the City Council is required to hold a public hearing and make certain findings prior to the expenditure of tax increment funds by the Redevelopment Agency for the construction of publicly owned facilities. In anticipation of the public hearing, a Notice of Public Hearing has been published twice in the Herald News and a copy of the Financial Summary Report has been made available for public review. The attached Summary Report, which is required by law, provides an estimate of the amount of tax increment funds to be expended for the project by the Agency, and also sets forth the findings justifying such expenditure. On May 7, 1992 bids for the project were received from fourteen (14) contractors. The bidding procedure was conducted in accordance with the City's purchasing procedures and State law. Based on review of the bids, staff is recommending that the contract be awarded to the lowest responsible bidder in the amount of $1,063,920.25 (plus allocate a 10% contingency of $106,392 for a total cost of $1,170,312.25). Construction of the work is scheduled to commence June 12, 1992 and be completed October 1992. The Highland Haven Target Area committee is in support of the project. On the June 2, 1992 Redevelopment Agency agenda, the Agency will consider the award of a contract to C.P. Construction Company, Inc. for the construction of the sewer and storm drain improvements in Highland Haven. However, prior to the Agency awarding this contract, the City Council must first hold a public hearing and make certain findings as set forth in the attached Summary Report and consent to the expenditure of redevelopment funds for the project. • • 3 ALTERHATIVE(S): • In considering this matter, the City Council has several alternatives: 1. Adopt the Resolution consenting to the expenditure of funds by the Fontana Redevelopment Agency related to the construction of sewer and storm drain improvements in the Highland Haven Target Area (North Fontana Redevelopment Project) (Staff Recommendation). 2. IV DETERMINATIONS PURSUANT TO HEALTH AND SAFETY CODE 33445 A. Benefit to Project Area The Highland Haven Target Area has been on septic tank systems since its development 30-40 years ago. Because of past failures and the potential for the continued failure of these systems, the Santa Ana Regional Water Quality Control board has precluded any further development in the area. In addition, the area is subject to flooding during heavy rainfall due to the absence of drainage facilities. The construction of sanitary sewers and storm drain facilities in the Highland Haven Target Area will enhance the quality of life of the residents, increase property values, improve the desirability of the area and will enable new development to occur. B. Financing Alternatives It has been determined that tax increment financing will be necessary for this project, as there are no other reasonable means of financing available to the City. Although the City has both sewer and storm drain fee structures in place, revenues from these two sources are restricted in use to regional and/or master plan facilities and are therefore not available for neighborhood systems. In addition, due to severe budget limitations, there are no revenues available in the City's General Fund for this project. V REDEVELOPMENT PURPOSE The construction of the proposed sewer and storm drain improvements is necessary to effectuate the purpose of the North Fontana Redevelopment Plan. Such construction is also necessary in order for the Redevelopment Agency to implement the provisions of the approved Housing and Infrastructure Revitalization Program for the Highland Haven Target Area. Finally, construction of the proposed improvements will enable the Agency to eliminate a barrier to development and redevelopment in the area. Total construction costs are $1,170,312.25 (includes 10% contingency). The Engineer's estimate was $1,500,000. A portion of the contract is expected to be paid in fiscal year ending June 30, 1992 in the amount of $100,000. This amount is appropriated in the current budget. The remaining cost of $1,070,312.25 is included in the proposed Agency budget for fiscal year ending June 30, 1993. III In addition to t•construction contract with C.• Construction Co., Inc., staff requests authorization to amend the current J.F. Davidson Associates, Inc., contract to provide necessary technical surveying, design and soils testing related to the construction of the improvements in the amount of $132,202 (which is 38% of the previous contracts). The amount of the Original Contract and Amendment No. 1 was $346,000. Since inception of this project 1989 Davidson has worked on this project by determining the infrastructure and housing deficiencies in the area. They have also been responsible for the preparation and design plans and specifications. Therefore, Amendment No. 2 is a continued logical extension of the existing contract (Page 20). It would not be time efficient or cost effective to rebid the Scope of Work that will be performed by Davidson. Additionally, City Public Works' staff will provide the necessary management and inspection of the project, and charge the Redevelopment Agency for these services in the approximate amount of $58,000. Staff costs are provided in the proposed fiscal year ending June 30, 1993.Agency budget. Therefore, the total project cost is $1,360,514.25. A break down of the total project costs are summarized in the Summary Report which is included in a companion City Council Agenda Item dated June 2, 1992. REVIEWED BY: - Those benefitting property owners who meet the criteria outlined in the Plan, can apply to the Agency for waiver of their pro-rata share. - Those benefitting property owners who do not meet the outlined criteria, such asowners of vacant property, will not be eligible to have their prorata share waived and therefore upon development must pay their share of the improvement costs. - The City Council will need to amend its sewer and storm drain Ordinances to increase the respective fee for this area only to include the pro-rata share. - Those eligible property owners meeting the income criteria under the CDBG Program (80% of median income). will be eligible to obtain a sewer connection right ($1500). The CDBG Program recently purchased 150 sewer connection rights at $1500 per connection. These rights were purchased exclusively for Highland Haven residents who meet the income criteria. This summarizes the major key points of the Plan. Please refer to the attached Plan for further specifics. The Highland Haven Committee has reviewed the Plan, andgenerally is in agreement with the Plan. This program outlined the provision of various public improvements such as sewer, storm drains, streets, curbs, gutters, etc., and rehabilitation and development of housing. JUSTIFICATION: The approved Program involves Redevelopment Agency expenditures of up to $3 million from its North Fontana 20% Set Aside Funds. Phase I Improvements are estimated to cost up to $1.9 million and Phase II improvements are estimated to cost up to $1 million. These are only estimates since the improvements have not been placed out to bid. Once the bids are received, precise cost can be determined. Additionally, the Agency may receive reimbursements from outside benefiting development and from property owners who do not qualify for the Program. • • On September 3, 1991 the Agency approved the Financing Plan and Implementation Schedule for the Highland Haven. Target Area within the North Fontana Redevelopment Project Area (AKA: "Housing and Infrastructure Revitalization Program"). The Plan provided for the construction of certain public improvements such as sewer, storm and street improvements in two (2) phases. Furthermore, this plan provided for the commencement of Phase I Improvements (sewer,street repairs and storm drains) about November 1, 1991 with an anticipated completion date of April 1992. Accordingly, staff requests the Agency's authorization to advertise for bids for the Phase I improvements. In July 1989, the Agency approved in concept a Redevelopment Housing Assistance/Enhancement Program within Redevelopment Project Areas and specifically authorized staff to initiate a Pilot Housing Program in the North Fontana Project Area. As a result, in September 1989, the Agency authorized Staff to retain the services of J. F. Davidson Associates, Inc. to ascertain the housing conditions and infrastructure constraints and deficiencies within the neighborhood of "Highland Haven" in North Fontana. On June 5, 1990, the Agency approved a "Housing and Infrastructure Revitalization Program" for the Highland Haven area. The prime purpose of this Program is to revitalize and enhance a residential neighborhood suffering from physical, social and economic deficiencies and to further fulfill the requirements of the redevelopment law, wherein the Agency must utilize its 20%. set aside funds to expand housing opportunities for low/moderate persons. Moreover, it, is important to recall that, thisareawas selected primarily because of its depressed and blighted conditions and lack of essential public improvements. The Program is intended to serve as a catalyst Pilot Program. Upon commencement and successful completion of this Program, it is intended to utilize and expand. this Program for other areas such as the Downtown where there is also.a great need to improve housing and infrastructure conditions. In June, when the overall Program was approved by the Agency, the Agency_ directed staff to prepare a comprehensive Financing Plan and Implementation;' Schedule to be brought back to the Agency for their consideration.. Attached for your review is the proposed Public Improvements Financing Plan and Implementation Schedule. In summary the Plan describes the following: - The Agency will advance and provide'" the funds necessary to implement the Programs from its North Fontana 20% Set Aside Funds of up to $3 million. - The Program involves 'construction of public improvements in two (2) Phases. Phase I - consists of construction of sewer lines inclusive of. acquisition of necessary easements. (this item is on tonight's City Council Agenda - if the Agency doesnot approve this Plan that item will be unnecessary), street repairs, and storm drains at the estimated cost of.. $1.9 million. Phase II consists of construction of street improvements such as sidewalks, curbs, gutters at the estimated cost. of $1 million. - Phase I is scheduled to commence April 1992. The CDBG Program recently purchased 150 sewer connection rights at $1500 per connection. These rights were purchased exclusively for Hight -arid Haven residents Who meet the income criteria. This summarizes the major key points of the Plan. Please refer to the attached Plan for further specifics. The Highland Haven Committee has reviewed the Plan, and generally is in agreement with the Plan. FRA 91- G3 A RESOLUTION OF THE FONTANA REDEVELOPMENT AGENCY APPROVING THE PUBLIC IMPROVEMENTS FINANCING PLAN AND IMPLEMENTATION SCHEDULE FOR THE HIGHLAND HAVEN TARGET AREA WITHIN THE NORTH FONTANA REDEVELOPMENT PROJECT AREA (HOUSING AND INFRASTRUpTURE REVITALIZATION PROGRAM); AND AUTHORIZING STAFF TO TAKE ALL APPROPRIATE ACTIONS IN ORDER TO IMPLEMENT THE PLAN. WHEREAS, Section 33334.2 of the California Health and Safety Code requires that not less than 20% of all taxes allocated to the Fontana Redevelopment Agency (the "Agency") shall be used by the Agency for purposes of increasing and improving the community's supply of low and moderate income housing; and WHEREAS, Section 33334.2(3)(e)(2) of the California Health and Safety Code specifically authorizes the Agency to improve land or building sites with onsite or offsite improvements, if such improvements directly and specifically improve or increase the community's supply of low and moderate income housing; d WHEREAS, the provision of the proposed public infrastructure improvements will benefit a neighborhood predominantly comprised of low and moderate income persons; and WHEREAS, Section 33445provides, that the Agency may, with the consent of the City Council, pay all or part of the value for and the cost of the installation and construction of any building, facility structure, or other improvement which is publicly owned within or out of the Project Area, if the City Council determines the following: (1) That the facilities, and/or other improvements are of benefit to the Project Area in which the proposed Project is located; and' (2) That no other reasonable means of financing such buildings, facilities, and structures, orother improvements, are available to the community. WHEREAS, the proposed project is consistent with the North Fontana Redevelopment Plan approved and adopted by the Fontana City Council by Ordinance No. 739 on December 21, 1982 and the City's General Plan adopted and approved on May 15, 1990; and Page 1 of 3 RESOLUTION NO. I. PROGRAM DESCRIPTION o The installationcof the pUblid.improvements will occur. in two phases. Phase I, involving the installation of sewers and a "dry" storm drain system, Is estimated to begin by November 1, 1991 and should be•comPleted by March of 1992. Phase II, involving the installation of curb, gutter and sidewalk, will not be initiated until the first -phase improvements are: completed, there are sufficientfunds available and certain drainage issues existing to the south of the neighborhood have been resolved.. o The Redevelopment Agency will finance the installation of the Phase I public improvements with 20% tax increment set -aside housing funds, which, pursuant to State Law, are restricted in use to increasing and/or improving the City's supply of low and moderate income housing. If it is determined to proceed with Phase II, these improvements may also be funded with 20% set -aside funds.•. o In all likelihood not all of the owners of property Which will benefit from the public improvements are of low or moderate income. Therefore, in order to assure that to the extent possible property owners who are not low/moderate income pay their fair share of the cost of the improvements, the Agency proposes: • - to spread the:.Cost of the improvements over all of the benefitting properties within the target area to arrive-at,iiper parcel pro-rata shares of such costs. - to request the City to amend its Sewer Ordinance establishing a separate sewer connection fee for Highland Haven consisting of the current sewer connection right fee plusthe'per parcel pro -rate share of the total cost of the sewer improvements payable by eachowner. - to develop an'application process to be used in concert with the City's sewer connection permitting process, to identify and confirm low and moderate income homeowners. - to waive the per .arcel pro-rata share sewer fee for any low or moderate income homeowner (owner occupant or investor owner) desiring to hook up to the sewer andwilling to execute and have recorded, a deed restriction on their property, restricting the use of such property to low/moderate income households. - to require that those homeowners not meeting the low/ moderate income criteria and owners of vacant parcels pay their connection right fee and their pro-rata_share sewer fee in order to hook up to the sewer. - to request the City to amend the appropriate Ordinance(s) in order to levy a fee for the pro- rata share of the street and storm drain improvements asa condition of building permit issuance for any new development in Highland Haven. - to establish a method by which the City will turn over all pro -;rats share fees collected within area. to the Agency -for *deposit in the North Fontana Low/Moderate Income. Housing Fund. II. PROGRAM CRITERIA o For purposes of this project the following definitions shall apply: - Area Median Income - The median income for San Bernardino County as published from time to time by the. Davidson Associates, Inc., to prepare a report which would outline the housing conditions and infrastructure deficiencies within the Highland Haven neighborhood of North Fontana. The Highland Haven neighborhood is located south of Highland Avenue, north of Baseline Road, west of Citrus Avenue and east of Almeria (Page 4). Since 1989, staff has been working with and holding evening meetings (as needed) with the Highland Haven Target Area Committee which is comprised of twelve volunteer members. The members have provided assistance and guidance to staff and consultants in determining the needs within the community. • • • On June 5, 1990, the A•cy approved a Housing and infraucture Revitalization Program for Highland Haven based on J.F. Davidson's final report and authorized staff to develop and prepare a comprehensive financing plan and implementation schedule for the Program (Page 5). On November 6, 1990, the Agency authorized the execution of a Consultant Services Agreement with J.F. Davidson Associates, Inc., to prepare plans and specifications for certain public improvements identified in the June 5, 1990 Housing and Infrastructure Revitalization Program. The Agency also made certain findings with respect to the use of tax increment 20% set -aside funds for the design and construction of these public improvements (Page 6). On March 19, 1991, the Agency approved Amendment No. 1 to Consultant Services Agreement to provide for additional Design Engineering Services related to the. "Housing and Infrastructure Revitalization Program" (Page 7). On September 3, 1991, the Agency approved the Public Improvements Financing Plan and Implementation Schedule and authorized staff to take all appropriate actions to implement the Plan in accordance with the. Housing and Infrastructure Revitalization Program (Page 8). ANALYSIS AND JUSTIFICATION: On June 2, 1992, the Agency awarded the construction of sewer and storm drain to C.P. Construction Co. Inc., and approved Amendment No. 2 to the J.F. Davidson,' Inc. Consultant. Services Agreement to provide necessary technical surveying, design, and soils testing (Page 9). Amendment No. 3 is required because of the cost overrun which has occurred in the last month for the soils engineer. When the Contractor began the backfill of the trenches the City's Public Works Inspector determined that due to the percent of rock in the backfill material, field density testing was not feasible. In order to insure the City against future liabilities the City's Engineering Division requested that a soils engineer be on site full time to observe the backfilling operations to verify that sufficient compactive effort is being applied and to perform moisture testing to verify that adequate water is being applied to the soils. The City's Public Works Inspector is on site full time (8 hours) and has verified that the soils engineer has in fact been on site full time during the duration of the construction. The full time soils engineer was not expected to be needed at the time of the award of the J.F. Davidson contract in June 1992. Accordingly, staff recommends that the Executive Director approve and execute Amendment No. 3 to the original Contract in the amount not to exceed $16,000 (Page 10). Amendment No. 3, contains Exhibit "A", J.F. Davidson letter which itemizes the $16,000.
