The Contractor shall notify the Engineer and the appropriate regional notification center for
operators of subsurface installations at least 2 working days, but not more than 14 calendar
days, prior to performing any excavation or other work close to any underground pipeline,
conduit, duct, wire or other structure. Regional notification centers include but are not limited

City of Fontana to construct the Slover Avenue Sewer from
Hemlock Avenue to Poplar Avenue.
We anticipate construction to begin on this project on

A. GENERAL DISCUSSION OF CONTRACTUAL, LEGAL AND PERMIT ASPECTS:
STATUS OF CONTRACT:The contract documents were hand delivered
to Bonadiman-McCain, Inc.'s office, Monday September 20, 1999
for execution and to be returned to the City of Fontana for
City's execution.
INITIATING CONSTRUCTION:(NOTICE TO PROCEED)Will be issued
after contract has been fully executed by Contractor and
City Officials, and after copies of the Contractor's
Insurance Certificates, City's Public Works Construction
permits, and business license have been submitted to the
Project Manager.
EMERGENCY INFORMATION FORM:Given to Contractor at pre -
construction meeting, Contractor is to turn in before the
"Notice to Proceed" (and/or City's Construction Permit and
business license) will be issued.
REQUIRED PERMITS:Prior to the start of any work, the
Contractor shall take out "Applicable City Permits", City
will obtain the County's Public Works Construction Permit. A
City Public Works Construction permit (no -fee) is required
before construction can begin. (SP-8. Sec. 7-5)
COMPLETION TIME FOR CONTRACT:The contractor has 45 working
days after "Notice to Proceed" is issued, excluding holidays,
weather days and maintenance days (GC-2).
LIQUIDATED DAMAGES:The City and contractor agree that if the
work is not completed within the period provided in the
General Conditions that the sum of $500 for each and every
Calendar Day of such delay shall be charged,
(SP-6, Sec. 6-9).
OTHER REQUIREMENTS OF CONTRACT DOCUMENTS:(To include City of
Fontana Business License and all Appropriate State of
California Required Licenses). Contractor and all Sub -
Contractors shall provide a copy of their City of Fontana
Business License to the Project Manager.
B. CONTRACTORS SCHEDULE:
MATERIALS TO BE FURNISHED BY OWNER:None.
MATERIALS TO BE FURNISHED BY CONTRACTOR: (Shop Drawing
Submittals)Refer to "Green Book - Subsection 4-1.6 "Trade
Names or Equals". The specified contract completion time
shall not be effected by anv circumstances developing from
provisions of this subsection.
CONTRACTORS SCHEDULE:The Contractor shall submit periodic
Progress Reports to the Engineer by the tenth day of each
month. The report shall include an updated Construction
Schedule. Anv deviations from the original schedule shall be
explained. Progress Payments will be withheld pending
receipt of anv outstanding reports. (SP-4, Sec. 6-1)
SUBCONTRACTORS:No change in Subcontractors is allowed prior
to the written approval from the City.
WORKING HOURS:Working hours shall be confined to the hours
between 7:00 a.m. and 4:00 p.m., Monday through Friday,
excluding Holidays. (SP-5, Sec. 6-7.2)
C. PAYMENTS
PROGRESS PAYMENTS:ProgressPayments shall be submitted in the
format required by the City (See Sample Provided). Any
Progress Payment submitted differently than the format
required by the City, shall be returned for correction. The
date of the submittal will be counted from the date the final
progress payment is received in the City's Accounts Payable
Department.
10% RETENTION MONIES:Pursuant to the Contract documents 100
Retention Money will be withheld from each Progress
Payment.
CHANGE'ORDERS:No extra work will be performed without an
approved change order from the City Engineer.
CERTIFIED PAYROLLS:"Certified Payroll Records" shall be
submitted to the City by the tenth day of each month.
"Progress Payments" will be withheld pending receipt of any
outstanding reports (SP-12, Sec. 7-15). Contractor shall
also be responsible for the "Certified Payroll" for all of
their Subcontractors.
D. RIGHT OF WAY AND UTILITIES:
NOTIFICATION OF AGENCIES:The County of San Bernardino,
Caltrans, and any other required Agencies shall be notified
48 hours in advance "Prior" to starting work within their
right-of-way or as required by the specific agency.
COORDINATION WITH OTHER AGENCIES:Contractor shall make
arrangements for City, County, Caltrans or any other Utility
Companies as required for any inspections.
RIGHT-OF-WAY REQUIREMENTS:City will acquire all right-of-way,
easements and rights of entry as required for this project.
Contractor shall verify that the acquisition(s) are completed
prior to beginning any work outside the Public Right-of-way
(SP-3, Sec. 2-8).
NOTIFICATION OF UTILITIES:Contractor is responsible for
calling "Dig Alert" and providing the City with their
"confirmation number" prior to start of work. Notify non-
member utility companies separately. Caltrans is a non-
member.
COORDINATION WITH UTILITIES:The Contractor shall notify the
utilities designated in the "General Conditions" at least 48
hours in advance of excavating around any of their
structures. Contractor must coordinate with Gas, Water &
Telephone companies for relocation of their respective
utility lines (SP-4, Sec. 5-1).
EASEMENTS REQUIREMENTS:(UTILITIES)None.
UTILITY SERVICE PAYMENTS:The Contractor and the
Subcontractors will be responsible for payment of all the
Utility billings until the Citv's acceptance of project for
"operation and maintenance".
E. ENGINEERING/INSPECTION AND SURVEYING
STAKING:All construction survey staking shall be coordinated
through the City. Inspector. Construction survey staking
shall be provided by the Citv's consulting engineer (SP-3,
Sec. 2.9.2).
RECORD DRAWINGS:Contractor to provide City with red -
lined blueprint markups of all changes to plans at the end of
contract work.
MATERIALS AND SOILS TESTING REQUIREMENTS:Field density tests
will be made by the Geo Technical Engineer during the course
of construction at the expense of the City (SP-17, Sec. 211-
2.2). All calls for testing services shall be coordinated
through the City Inspector. Geo Technical Consultant shall
not respond to any direct calls from the Contractor.
F. CONSTRUCTION
TRAFFIC CONTROL:Special attention is called out in Section
7-10 The Contractor's operations shall cause no unnecessary
inconvenience. The access rights of the public shall be
considered at all times. Unless otherwise authorized, traffic
shall be permitted to pass through the work area (SP-9, Sec.
7-10.1; SP-11, Sec. 7-10.3).
PROTECTION OF EXISTING FACILITIES:The Contractor shall
exercise extreme care to protect all existing utilities in
place whether shown on plans or not, and shall assume full
responsibility for all damage resulting from his operations.
DUST CONTROLS:Shall be provided as required per Section 7-8.1
of the Standard Specifications for Public Works Construction.
STORAGE OF MATERIAL AND EQUIPMENT:No more than 1000 linear
feet of pipeline shall be stockpiled on the site, regardless
of size. The Contractor shall assume full responsibility for
any damage caused by stockpiling and shall repair same at his
expense (SP-10, Sec. 7-10.2).
JOB SAFETY:Shall be maintained at all times in accordance
with applicable laws.
JOB SECURITY:Contractor shall be responsible at all times.
G. OTHER MISCELLANEOUS ITEMS AND/OR COMMENTS, CONCERNS, QUESTIONS:
H. FINAL ACCEPTANCE OF WORK:
FINAL INSPECTION REPORT:Project will not be accepted for
operation and maintenance until all punch list items are
corrected and is to the satisfaction of the City, County, and
other Agency Inspectors.
FINAL ACCEPTANCE BY CITY COUNCIL:The following conditions
shall be fulfilled:
1.) Project is accepted by the City Staff for Operation and
Maintenance.
Project will then be scheduled for a City Council Meeting for
"Final Acceptance" and authorization to file the "Notice of
Completion" with the County Recorder's Office.
