The second statement should read: "Per the CALIFORNIA CIVIL CODE section 3186, the City retains an amount sufficient to answer the claim stated in the stop notice and to provide for the public entity's reasonable cost of litigation thereunder." 150% is probably a rule of thumb. However, it could end up being lower than that, since, as noted in the first statement, only an additional 25% is considered sufficient when getting a bond. However, in cases involving smaller claims, even 50% may not be enough to cover litigation costs (in proportion to the cost of the claim). Finally, it should be noted that these two statements are alternative. In other words, if the entity chooses to accept a payment bond, it can't hold other retentions on account of the stop notice. Ayala Boring reached an agreement on April 4, 2003 with the City for$ 11,323.63 as full payment for extra work. According to"California Contract Law"at that time Ayala should have sent a"Release of Stop Notice" since it incorrectly states the amount due to Ayala and it's illegal to have on file a stop notice stating a higher value that what is due. It is within your right to submit another notice but for the correct amount due. However, in your letter dated April 4, • 2003 to A.D. you stated you would be forwarding a"Release of Stop"shortly since a settlement was reached yet this has never been done. The delay in processing your claim and several others was not a result of A.D. General Engineering but was from the negligence of Mr. Tom Holiman of Associated Engineers. A.D. kept Ayala up to date as to the status of your claim throughout. After speaking to Kathy from your office she informed us that Ayala will not release the stop notice even though the amount stated is incorrect, unless Ayala is paid in fall by cashiers cheek, A.company check would not be • acceptable. I find this attitude uncalled for, offensive and bad business. Retention is due to be released on July 23, 2003, once A.D. receives payment we shall make payment provided we have received all releases. Your prompt attention is required in this matter.
