1. CONTRACT DOOL MENT5:.51ha11 consist of specifications and Its general conditions cid the
drawings. The Ment of these documents is to include all labor, materials, and services necessary
for the proper execution of the work The documents are to be considered as one, and whatever
to called for by any part shall be as binding as if called for by all parts.
2. VERIFICATION: The contractor shall verify measurements on the drawings before beginhg
work In case of error or discrepancy In the drawings or specifications or in work of others
affecting his work he shall notify the owner's represonWtve irrned►ately. The contractor shall
be held responsible for any damage or loss abate to his failure to observe these instructions.
3. LiC&6E. All work shall be performed by a C-27 California Licensed Lana+scgae Contractor.
4. iN%#k* Z. The Contractor shall cavy all hbrkyws Compensation, P*ib,,- Liability and
M,operty Oamage Insurance as required by all applicable codes, regulations and the ower.
.5. LANDSCAPE ARCHITECT'S LIASIL17Y: The ower and contractors, recognizing the k0went
risks connected with construction, agree to limlt any and all liability, claim for damages, cost of
defense, or expenses to be levied against the Landscape Architect on account of any design
defect, erroromission, or professional neglkjence to a sun not to exceed t50,000, or the
amount of the Landscape Architects fee, whichever is lesser.
6. CC *TRUGTION SAFETY: The desIT, adequacy aid safety of erection, excavation, bracing,
shorhg, temporary supports, etc, is the sob responsbility of the Contractor, and has not been
considered by the landscape Architect or his consultants. The contractor is responsible for the
stabllity of any structures and excavations and shall provide the necessary bracing to provide
stability daring the entire construction progress. Observation visits to the site by the Landscape
Arahltect or his consultants shall not include inspection of the above Items.
7. SUQVEY5, PERMITS, R LATIONS:The owner shall furnish an adequate survey of the
property. The contractor shall obtain and pay for all permits and comply with all laws and
ordinances bearing on the operation or caxt ct of the work as dra-m and specified. If the
contractor observes haat a variahre exists therewith he shall pronrtly notify the owner's
representative in wrltinq� and any necessa y charges shall be adjusted as provided in the contract
for changes in the work
6. PROTECTION OF MMK PROPERTY AIV PER50N: The contractor shall adequately protect the
work adjacent property and the public, did shall be responsible for any damage or injury dire to
his act.

10. PROVISIONS FOR EXTRAS: No new work of any kind shall be considered an extra unless a

14. CLARIFICATION OF DRAWINGS Mr -ORE B100IN6: After reviewing the drawings thoroughly it
Is the contractors responsbllity to clarify with the L arzbcgoe Architect or owners representative,
any questions the contractor may have regarding the method of construction, quantities, or
quality of materials Indicated or called at. If the contractor carat contact the Landscape
Architect or owners representative, the contractor must qualify his bid or accept the
Interpretation of tae Landscape Architect or owner's representative on the questionable areas as
they develop during construction.
13. SAkfl.br5 The Landscape Architect reserves the right to take aid analyze samries of materials
for conformity to specifications at any One. The contractor shall hmIM samples upon request
by to ia►dscope Architect. Rejected material shall be bmmedatek removed from the site and
replaced at contractors *,pone. The cost of testing materials not meethg specifications shall be
paid for by the contractor.

Architect at least 7 days before beginning work The purpose of anis conference is to review any
questions the contractor may have regarding to work adnhlstrative proved res airing
constructions and project wdrk scheairle.
17. C.OHOLET10N: Completion is defined as being when all conditions of the contract have been
acconpiished. 5peclfkall when all Items are Installed the areas cleaned and the maintenance
period satbfactorll completed, and then all special tools and equPment, instructions, written
guarantees, as wilt plans, lien rebases and any Items required by the contract documents have
been properly executed and delhwed to to ower. The Landscape Architect shall have full
wthorlty to accept or reject the contrxt Items cid will Pr'o"Ptt notify the ower of completion.
16. GUARANTEE: In addition to specified guarantees provided for in the separate sections of the
specifications, the contractor sinall guarantee In writing all Norkwnshp and materials to be free
from defect for a period of one year from the date of acceptance of the work by the owner
