Construction Inc. coniQected to perform the construction work
on which this action is brought in San Bernardino County, Cal-
ifornia. Plaintiff delivered its equipment and materials to
the construction site in San Bernardino County, California.
8. The defendant owner, City of Fontana, at all times
mentioned herein owned, and now owns, certain real property
and improvements in San Bernardino County, California, more
particularly described as:
Sewer Force Main for Tamarind Avenue and Sewer Lift Station
No. 8, Fontana, California.
9. The defendant owner, City of Fontana, and the defendant
contractor, Multi Construction Inc. on or about March 16 1993
entered into an agreement whereby the defendant contractor
agreed to perform a work of improvement on the above -described
property.
10. From about July 19 1993 through August 13 1993, at
the request of Multi Construction Inc., and with the knowledge
and authority of the City of Fontana, plaintiff furnished to
Multi Construction Inc two Essco submersible pumps, two 30
h.p. electric motors and various accessories for an agreed
upon sum of $67,128.25, all of which equipment was in fact
incorporated and used in the above -mentioned work of improvement.
The reasonable value of plaintiff's contribution was and is
$67,128.25. Plaintiff has not been paid this amount or any
part thereof.
